The National Commission for Women (NCW) organised a consultation on women’s property rights and access to social and economic justice to promote inclusive and sustainable development.
Women’s empowerment means ensuring that women have equal rights, opportunities, resources and decision-making power in social, economic and political life.
It requires changing patriarchal attitudes and recognising women as active participants in development rather than merely beneficiaries of welfare schemes.
Distributive Justice:
Ensures the fair and equitable distribution of resources and opportunities.
Promotes equality and prevents the concentration of wealth and resources.
Helps women become economically independent.
Compensatory Justice:
Provides protection, relief or compensation to address discrimination, exploitation and injustice.
Includes legal safeguards, welfare schemes and reservation.
Key Point: Women’s empowerment should move beyond compensatory justice towards distributive justice, making equality a matter of right rather than welfare.
Article 38: Directs the State to promote social welfare and reduce inequalities.
Article 39: Provides for adequate livelihood opportunities and equitable distribution of material resources.
Article 46: Promotes the educational and economic interests of weaker sections.
Article 21: Protects life and personal liberty, including human dignity.
Article 300A: No person shall be deprived of property except by authority of law.
Article 17: Abolishes untouchability.
Article 23: Prohibits human trafficking, begar and forced labour.
Hindu Succession Act, 1956: Governs inheritance among Hindus.
2005 Amendment: Granted daughters equal coparcenary rights in Hindu joint family property.
Vineeta Sharma v. Rakesh Sharma (2020): The Supreme Court held that a daughter acquires coparcenary rights by birth, irrespective of whether her father was alive on the date of the amendment.
Hindu Marriage Act, 1955 and Special Marriage Act, 1954: Provide legal frameworks relating to marriage and associated rights, including certain property-related matters.

Patriarchal mindset: Women are often discouraged from claiming their inheritance.
Lack of legal awareness: Many women do not know their property rights.
Limited access to justice: Legal procedures may be costly and complicated.
Social barriers: Family and community pressures discourage women from claiming property.
Weak implementation: Existing laws do not always translate into actual ownership and control of assets.
Gender-sensitive land records: Ensure proper recording of women’s ownership and inheritance shares.
Digitisation of land records: Improve transparency and reduce disputes.
Simplified mutation procedures: Make the transfer of inherited property easier.
Legal awareness campaigns: Use Self-Help Groups (SHGs) to educate women about their rights.
Free legal aid: Improve access to legal assistance.
Women’s leadership: Promote women to leadership positions in institutions and decision-making bodies.
Women-led development means recognising women as leaders and active agents of social and economic transformation, rather than passive beneficiaries of government schemes.
It focuses on equal ownership of resources, economic independence, participation in decision-making and leadership opportunities.
Women’s empowerment requires a shift from welfare-based support to rights-based equality. Ensuring property rights, effective implementation of laws and equal opportunities can strengthen women’s economic independence and help achieve the vision of Viksit Bharat@2047.
