Recently, women protesting at Delhi’s Jantar Mantar had their personal information (such as phone numbers, home addresses, and other private details) shared online without their permission.
After their details were leaked, many women received harassing messages, rape threats, death threats, and online abuse.
This incident has highlighted the growing problem of doxxing in India.
Doxxing means publicly revealing someone’s private or personal information on the internet without their consent.
The purpose is usually to:
Intimidate the person
Shame or embarrass them
Encourage online harassment or real-world attacks
Examples of Doxxing:
Posting someone’s phone number on social media.
Sharing home address or workplace details.
Revealing personal photographs or identity documents without permission.
Important: India does not have a separate law that specifically defines or punishes doxxing as an independent crime.
Since there is no dedicated anti-doxxing law, victims must rely on different existing laws.
Legal experts divide doxxing into two parts:
Sharing Personal Information: The act of leaking someone’s private data, usually dealt with under provisions of the Information Technology (IT) Act as a civil wrong rather than a serious criminal offence.
Threats and Harassment: Subsequent threatening calls, sexual harassment, stalking, or death/rape threats, which can be punished under criminal law.
Bharatiya Nyaya Sanhita (BNS), 2023:
Section 78 – Stalking: Applies when doxxing is used to repeatedly contact or monitor a woman online, or when the accused follows or harasses her through electronic communication.
Section 79 – Insult to Modesty or Privacy of a Woman: Applies when photos or personal information of a woman are published to insult her modesty or intentionally violate her privacy.
Section 351 – Criminal Intimidation: Applies when the victim receives death threats, rape threats, or serious threats intended to create fear.
Information Technology (IT) Act, 2000:
Section 66E – Violation of Privacy: Punishes capturing, publishing, or transmitting images of a person’s private body parts without consent.
Section 72A – Unauthorized Disclosure of Personal Information: Punishes disclosure of personal information without permission, carrying a fine up to ₹5 lakh. It is generally viewed as dealing mainly with wrongful disclosure rather than creating a separate offence of doxxing.
No separate offence specifically called doxxing.
Victims must rely on multiple laws instead of one comprehensive legal framework.
Existing laws mainly punish the consequences (stalking, threats, intimidation) rather than the act of leaking personal information itself.
This creates legal gaps and delays in providing effective protection.
Enact a standalone anti-doxxing law with clear definitions and punishments.
Strengthen digital privacy and data protection.
Ensure quicker removal of leaked personal information from online platforms.
Improve cybercrime investigation and victim support mechanisms.
Doxxing = Publishing someone’s private personal information online without consent to intimidate, harass, or threaten them. It is not yet a standalone offence in India, but related acts are punishable under the BNS and the IT Act.
हाल ही में, दिल्ली के जंतर-मंतर पर प्रदर्शन कर रही महिलाओं की व्यक्तिगत जानकारी (जैसे फोन नंबर, घर के पते और अन्य निजी विवरण) उनकी अनुमति के बिना ऑनलाइन साझा की गई।
उनके विवरण लीक होने के बाद, कई महिलाओं को निम्नलिखित का सामना करना पड़ा:
परेशान करने वाले संदेश
बलात्कार की धमकियां
जान से मारने की धमकियां
ऑनलाइन दुर्व्यवहार और डराने-धमकाने की हरकतें
इस घटना ने भारत में डॉक्सिंग (Doxxing) की बढ़ती समस्या को उजागर किया है।
डॉक्सिंग का अर्थ है किसी की सहमति के बिना इंटरनेट पर उसकी निजी या व्यक्तिगत जानकारी को सार्वजनिक करना।
इसका उद्देश्य आमतौर पर निम्नलिखित होता है:
व्यक्ति को डराना-धमकाना
उसे शर्मिंदा करना या अपमानित करना
ऑनलाइन उत्पीड़न या वास्तविक दुनिया के हमलों को बढ़ावा देना
डॉक्सिंग के उदाहरण:
सोशल मीडिया पर किसी का फोन नंबर पोस्ट करना।
घर का पता या कार्यस्थल का विवरण साझा करना।
अनुमति के बिना व्यक्तिगत तस्वीरें या पहचान दस्तावेज उजागर करना।
महत्वपूर्ण: भारत के पास ऐसा कोई अलग कानून नहीं है जो विशेष रूप से डॉक्सिंग को एक स्वतंत्र अपराध के रूप में परिभाषित या दंडित करता हो।
चूँकि कोई समर्पित एंटी-डॉक्सिंग कानून नहीं है, इसलिए पीड़ितों को विभिन्न मौजूदा कानूनों का सहारा लेना पड़ता है।
कानूनी विशेषज्ञ डॉक्सिंग को दो भागों में विभाजित करते हैं:
व्यक्तिगत जानकारी साझा करना: किसी का निजी डेटा लीक करने का कृत्य, जिसे आमतौर पर सूचना प्रौद्योगिकी (आईटी) अधिनियम के प्रावधानों के तहत एक गंभीर आपराधिक अपराध के बजाय सिविल गलत (civil wrong) माना जाता है।
धमकियां और उत्पीड़न: जानकारी लीक होने के बाद, पीड़ितों को धमकी भरे कॉल, यौन उत्पीड़न, पीछा करना (स्टॉकिंग), या जान से मारने/बलात्कार की धमकियां मिल सकती हैं, जिन्हें आपराधिक कानून के तहत दंडित किया जा सकता है।
भारतीय न्याय संहिता (BNS), 2023:
धारा 78 – पीछा करना (Stalking): तब लागू होती है जब डॉक्सिंग का उपयोग किसी महिला को बार-बार ऑनलाइन संपर्क करने या उसकी निगरानी करने के लिए किया जाता है, या जब आरोपी इलेक्ट्रॉनिक संचार के माध्यम से उसका पीछा करता है या उसे परेशान करता है।
धारा 79 – महिला की गरिमा या गोपनीयता का अपमान: तब लागू होती है जब किसी महिला की गरिमा को ठेस पहुँचाने या जानबूझकर उसकी गोपनीयता का उल्लंघन करने के लिए उसकी तस्वीरें या व्यक्तिगत जानकारी प्रकाशित की जाती है।
धारा 351 – आपराधिक धमकी (Criminal Intimidation): तब लागू होती है जब पीड़ित को जान से मारने की धमकियां, बलात्कार की धमकियां, या डर पैदा करने के उद्देश्य से गंभीर धमकियां मिलती हैं।
सूचना प्रौद्योगिकी (IT) अधिनियम, 2000:
धारा 66E – गोपनीयता का उल्लंघन: सहमति के बिना किसी व्यक्ति के निजी अंगों की छवियों को कैप्चर करने, प्रकाशित करने या प्रसारित करने पर दंडित करती है।
धारा 72A – व्यक्तिगत जानकारी का अनधिकृत खुलासा: अनुमति के बिना व्यक्तिगत जानकारी के खुलासे को दंडित करती है। इसमें ₹5 लाख तक का जुर्माना हो सकता है। इसे आम तौर पर डॉक्सिंग का एक अलग अपराध बनाने के बजाय मुख्य रूप से गलत खुलासे से निपटने के रूप में देखा जाता है।
डॉक्सिंग नामक कोई अलग अपराध नहीं है।
पीड़ितों को एक व्यापक कानूनी ढाँचे के बजाय कई कानूनों पर निर्भर रहना पड़ता है।
मौजूदा कानून मुख्य रूप से व्यक्तिगत जानकारी लीक करने के कृत्य के बजाय परिणामों (स्टॉकिंग, धमकियों, डराने-धमकाने) को दंडित करते हैं।
इससे कानूनी कमियां पैदा होती हैं और प्रभावी सुरक्षा प्रदान करने में देरी होती है।
स्पष्ट परिभाषाओं और दंडों के साथ एक स्टैंडअलोन एंटी-डॉक्सिंग कानून बनाया जाए।
डिजिटल गोपनीयता और डेटा संरक्षण को मजबूत किया जाए।
ऑनलाइन प्लेटफ़ॉर्म से लीक हुई व्यक्तिगत जानकारी को तेजी से हटाने की व्यवस्था हो।
साइबर अपराध जांच और पीड़ित सहायता तंत्र में सुधार किया जाए।
डॉक्सिंग = किसी को डराने, परेशान करने या धमकाने के लिए उसकी सहमति के बिना उसकी निजी व्यक्तिगत जानकारी को ऑनलाइन प्रकाशित करना। भारत में यह अभी तक एक स्वतंत्र अपराध नहीं है, लेकिन इससे जुड़े कृत्यों को BNS और IT अधिनियम के तहत दंडित किया जा सकता है।
