Article 124(2): Mandates that every judge of the Supreme Court is appointed by the President of India by warrant under his hand and seal, after consulting judges of the Supreme Court and High Courts as deemed necessary.
Article 124(3) – Eligibility Criteria: To be appointed, an individual must:
Be a citizen of India.
Have been a judge of a High Court for at least 5 years; OR
Have been an advocate of a High Court for at least 10 years; OR
Be a distinguished jurist in the opinion of the President.
Retirement Age: Judges hold office until they reach the age of 65 years.
The Collegium Model: Appointments are driven by the Supreme Court Collegium (comprising the CJI and the four senior-most judges), which recommends qualified names to the executive.
Executive Clearance: Recommendations are processed through the Ministry of Law and Justice and the Prime Minister’s Office before final approval and warrant issuance by the President.
Execution of Expansion: Following the legal increase in strength via ordinance and subsequent bill formalization, new seats are filled through routine collegium recommendations to operationalize the expanded benches.
संसद में भारी हंगामे के बीच पेशी: केंद्रीय कानून मंत्री अर्जुन राम मेघवाल ने लोकसभा में ‘सुप्रीम कोर्ट (न्यायाधीशों की संख्या) संशोधन विधेयक, 2026’ पेश किया। इस विधेयक को मई में जारी किए गए राष्ट्रपति अध्यादेश (Ordinance) की जगह लेने के लिए लाया गया है।
विरोध प्रदर्शन: विपक्षी सदस्यों द्वारा विभिन्न मुद्दों को लेकर नारेबाजी और भारी हंगामे के बीच यह विधेयक पेश किया गया।
लंबित मामलों का समाधान: इसका उद्देश्य सर्वोच्च न्यायालय में बढ़ते मुकदमों के बोझ से निपटना और न्यायाधीशों की स्वीकृत संख्या को 34 से बढ़ाकर कुल 38 (मुख्य न्यायाधीश सहित, और अन्य न्यायाधीश 33 से बढ़कर 37) करना है।
विधायिका संशोधन: यह ‘सुप्रीम कोर्ट (न्यायाधीशों की संख्या) अधिनियम, 1956’ की धारा 2 में संशोधन करता है।
न्यायाधीशों की संख्या: * पुरानी स्वीकृत संख्या: 33 अन्य न्यायाधीश + 1 मुख्य न्यायाधीश = कुल 34।
संशोधित स्वीकृत संख्या: 37 अन्य न्यायाधीश + 1 मुख्य न्यायाधीश = कुल 38।
उद्देश्य और कारण: * न्यायालय में 92,000 से अधिक मामले लंबित हैं, क्योंकि नए मामलों के दाखिल होने की दर उनके निपटान (Disposal) से लगातार अधिक है।
इससे भारत के मुख्य न्यायाधीश (CJI) को कानून के महत्वपूर्ण प्रश्नों से जुड़े मामलों की सुनवाई के लिए संविधान पीठों (Constitution Benches) का गठन अधिक नियमित रूप से करने में मदद मिलेगी।
अनुच्छेद 124(1): यह प्रावधान करता है कि भारत का एक सर्वोच्च न्यायालय होगा जिसमें भारत के मुख्य न्यायाधीश और, जब तक संसद कानून द्वारा बड़ी संख्या निर्धारित नहीं करती, तब तक सात से अधिक अन्य न्यायाधीश नहीं होंगे। संसद को सामान्य कानून के माध्यम से इस संख्या को बदलने का अधिकार है।
अनुच्छेद 124(2): इसके तहत सर्वोच्च न्यायालय के प्रत्येक न्यायाधीश की नियुक्ति भारत के राष्ट्रपति द्वारा अपने हस्ताक्षर और मुद्रा सहित वारंट द्वारा की जाती है। राष्ट्रपति आवश्यकतानुसार सुप्रीम कोर्ट और हाईकोर्ट के न्यायाधीशों से परामर्श करते हैं।
अनुच्छेद 124(3) – पात्रता मानदंड: न्यायाधीश बनने के लिए व्यक्ति को:
भारत का नागरिक होना चाहिए।
कम से कम 5 वर्षों तक किसी उच्च न्यायालय (या क्रमिक उच्च न्यायालयों) का न्यायाधीश रहा हो; अथवा
कम से कम 10 वर्षों तक किसी उच्च न्यायालय का अधिवक्ता रहा हो; अथवा
राष्ट्रपति की दृष्टि में एक प्रतिष्ठित विधिवेत्ता (Distinguished Jurist) होना चाहिए।
सेवानिवृत्ति की आयु: न्यायाधीश 65 वर्ष की आयु तक अपने पद पर बने रहते हैं।
कॉलेजियम मॉडल: नियुक्तियां सुप्रीम कोर्ट कॉलेजियम (जिसमें मुख्य न्यायाधीश और चार सबसे वरिष्ठ न्यायाधीश शामिल होते हैं) द्वारा संचालित की जाती हैं, जो योग्य नामों की सिफारिश कार्यपालिका को भेजती है।
कार्यपालिका की मंजूरी: सिफारिशों को कानून और न्याय मंत्रालय तथा प्रधानमंत्री कार्यालय के माध्यम से संसाधित किया जाता है, जिसके बाद राष्ट्रपति द्वारा अंतिम अनुमोदन और नियुक्ति वारंट जारी किया जाता है।
