The Supreme Court on 22 September 2026 heard a petition challenging the 2026 amendment to the Prevention of Insults to National Honour Act, 1971 and government directions concerning the singing of Vande Mataram.
A three-judge Bench headed by CJI Surya Kant sought the Centre’s response.
The Court indicated that the issue of imposing criminal consequences on a person who, due to genuine conscientious or religious belief, refuses to sing requires constitutional examination.
The case involves balancing:

The Prevention of Insults to National Honour Act, 1971 was amended in 2026 to extend statutory protection to the National Song.
Intentionally preventing the singing of the National Anthem or National Song, or causing disturbance to an assembly engaged in such singing, may attract imprisonment up to three years, fine, or both.
The challenge also concerns directions requiring the full six-stanza version of Vande Mataram at specified official functions.
The Court referred to the principle that a person with a genuine conscientious or religious objection should not automatically face criminal punishment merely for refusing to sing.
However, these are hearing-stage observations, not a final ruling on the constitutional validity of the amendment or government directions.
In Bijoe Emmanuel v. State of Kerala, the Supreme Court protected school students who respectfully stood during the National Anthem but did not sing because of their religious beliefs.
The judgment recognised the importance of freedom of conscience and constitutional tolerance.
The present case raises the question of how these principles apply to the National Song and its prescribed rendition.
Freedom of conscience: Protection of an individual’s sincerely held beliefs.
Compelled expression: Constitutional concern where the State requires a person to express a particular belief or sentiment.
Constitutional patriotism: Respect for national symbols must operate within the framework of constitutional rights.

सर्वोच्च न्यायालय ने 22 सितंबर 2026 को उस याचिका पर सुनवाई की, जिसमें राष्ट्रीय सम्मान के अपमान की रोकथाम अधिनियम, 1971 में 2026 के संशोधन तथा वंदे मातरम् के गायन से संबंधित सरकारी निर्देशों को चुनौती दी गई है।
मुख्य न्यायाधीश न्यायमूर्ति सूर्यकांत की अध्यक्षता वाली तीन-सदस्यीय पीठ ने केंद्र सरकार से जवाब मांगा।
न्यायालय ने संकेत दिया कि वास्तविक अंतःकरणगत अथवा धार्मिक विश्वास के कारण वंदे मातरम् गाने से इनकार करने वाले व्यक्ति पर आपराधिक दायित्व लगाया जा सकता है या नहीं, यह संवैधानिक परीक्षण का विषय है।
प्रकरण में निम्नलिखित के बीच संतुलन का प्रश्न उठता है—

संविधान का धर्मनिरपेक्षता का सिद्धांत
राष्ट्रीय सम्मान के अपमान की रोकथाम अधिनियम, 1971 में 2026 में संशोधन कर राष्ट्रीय गीत को भी वैधानिक संरक्षण प्रदान किया गया।
राष्ट्रीय गान या राष्ट्रीय गीत के गायन को जानबूझकर रोकना अथवा ऐसे गायन में संलग्न सभा में विघ्न डालना तीन वर्ष तक के कारावास, जुर्माने या दोनों से दंडनीय हो सकता है।
याचिका में कुछ निर्दिष्ट सरकारी समारोहों में वंदे मातरम् के सभी छह अंतरों के अनिवार्य गायन संबंधी निर्देशों को भी चुनौती दी गई है।
न्यायालय ने इस सिद्धांत की ओर संकेत किया कि वास्तविक अंतःकरणगत अथवा धार्मिक आपत्ति रखने वाले व्यक्ति को केवल किसी गीत के गायन से इनकार करने के कारण स्वतः आपराधिक दंड का सामना नहीं करना चाहिए।
हालांकि, ये सुनवाई के दौरान की टिप्पणियां हैं; संशोधन की संवैधानिक वैधता अथवा सरकारी निर्देशों पर अभी अंतिम निर्णय नहीं हुआ है।
बिजो एमैनुएल बनाम केरल राज्य में सर्वोच्च न्यायालय ने उन विद्यार्थियों के अधिकारों की रक्षा की थी, जो अपनी धार्मिक मान्यताओं के कारण राष्ट्रगान नहीं गाते थे, किंतु सम्मानपूर्वक खड़े रहते थे।
न्यायालय ने अंतःकरण की स्वतंत्रता तथा संवैधानिक सहिष्णुता के महत्व को मान्यता दी।
वर्तमान प्रकरण में यह प्रश्न महत्वपूर्ण है कि इन सिद्धांतों को राष्ट्रीय गीत तथा उसके निर्धारित गायन पर किस प्रकार लागू किया जाए।
अंतःकरण की स्वतंत्रता: व्यक्ति के वास्तविक एवं गंभीर रूप से धारित विश्वासों की संवैधानिक सुरक्षा।
विवश अभिव्यक्ति: ऐसी स्थिति जिसमें राज्य किसी व्यक्ति को किसी विशेष विचार या भावना की अभिव्यक्ति के लिए बाध्य करता है।
संवैधानिक देशभक्ति: राष्ट्रीय प्रतीकों के प्रति सम्मान का पालन संवैधानिक अधिकारों के अनुरूप होना चाहिए।
धर्मनिरपेक्षता: राज्य द्वारा सभी धर्मों के प्रति संवैधानिक निष्पक्षता बनाए रखना।
सर्वोच्च न्यायालय ने अभी अंतिम निर्णय नहीं दिया है।
केंद्र सरकार से जवाब मांगा गया है।
2026 के संशोधन की वैधता तथा वंदे मातरम् से संबंधित सरकारी निर्देश अभी न्यायिक विचाराधीन हैं।
राष्ट्रीय प्रतीकों के सम्मान और मौलिक अधिकारों के बीच संतुलन की परीक्षा करता है।
लोकतांत्रिक व्यवस्था में अंतःकरण की स्वतंत्रता के महत्व को रेखांकित करता है।
व्यक्तिगत विश्वास एवं अभिव्यक्ति से संबंधित मामलों में दंडात्मक कानून की सीमाओं पर महत्वपूर्ण संवैधानिक प्रश्न उठाता है।
“राष्ट्रीय प्रतीकों के प्रति सम्मान को अंतःकरण की स्वतंत्रता एवं मौलिक अधिकारों के साथ सामंजस्य स्थापित करते हुए लागू किया जाना चाहिए।” वंदे मातरम् पर सर्वोच्च न्यायालय की हालिया टिप्पणियों तथा बिजो एमैनुएल बनाम केरल राज्य में प्रतिपादित सिद्धांतों के आलोक में विवेचना कीजिए।
