A BBC News Hindi investigation found that six RUPPs based in Gujarat received around ₹1,700 crore in donations in 2023–24. This was higher than the combined donations received by five nationally recognised parties other than the BJP (₹1,480 crore).
The issue has raised concerns about transparency, political-party regulation, tax evasion and possible money laundering.
Registered Unrecognised Political Parties (RUPPs) are political parties registered with the Election Commission of India (ECI) but not recognised as a National or State Party.
Under Section 29A of the Representation of the People Act, 1951, citizens can form a political party and seek registration with the ECI.

Tax exemption on eligible political donations under the Income Tax law.
Common symbol for contesting Lok Sabha/State Assembly elections, subject to applicable rules.
Can have up to 20 star campaigners during elections.
Must maintain details of individual donors contributing more than ₹20,000 in a financial year.
Must submit required donation/contribution reports to the ECI.
Failure to furnish required information can result in loss of tax exemption.
Donations above the prescribed threshold must be received through banking channels such as cheque or bank transfer.
India has a very large number of RUPPs, but many do not actively participate in elections.
More than 2,800 RUPPs existed as of July 2025.
Only around 750 contested the 2024 Lok Sabha elections.
Parties that exist largely on paper are often called “letter-pad parties.”
The concern is that some inactive parties may potentially be used as opaque channels for financial transactions, including tax evasion and money laundering.
The Election Commission does not have a general power to deregister a political party simply because it does not contest elections or fails to meet certain compliance requirements.
In Indian National Congress v. Institute of Social Welfare (2002), the Supreme Court held that the ECI generally cannot deregister a political party under the RP Act.
Deregistration is possible only in exceptional circumstances, such as:
Registration obtained through fraud.
Party ceasing to have allegiance to the Constitution.
Party being declared unlawful by the government.
The Association for Democratic Reforms (ADR) found that only about 26% of RUPPs’ annual reports for 2022–23 were available in the public domain.
This indicates significant gaps in:
Financial disclosure
Donor transparency
Statutory compliance
ECI oversight
The key issue is the balance between the constitutional freedom to form political parties and the need for financial transparency and effective regulatory oversight.
The Constitution of India does not directly classify political parties as RUPPs, State Parties or National Parties. The regulatory framework mainly comes from the Representation of the People Act, 1951 and the Election Symbols (Reservation and Allotment) Order, 1968.
Section 29A of the Representation of the People Act, 1951 provides for registration of political parties with the Election Commission of India (ECI).
A registered party that does not satisfy the prescribed conditions for recognition remains a Registered Unrecognised Political Party.
RUPPs do not have the status of a State Party or National Party.
They do not get the same electoral privileges as recognised parties.
They may receive eligible political donations and claim applicable tax exemptions, subject to statutory conditions.
Their financial and organisational activities are subject to reporting and compliance requirements.
A registered political party becomes a recognised political party when it fulfils the conditions prescribed by the ECI under the Election Symbols (Reservation and Allotment) Order, 1968.
There are two categories:
State Party:
A party recognised within a particular State on the basis of prescribed vote-share and/or seat criteria.
National Party:
A party that fulfils prescribed criteria across multiple States and is recognised as a National Party.
Article 19(1)(c):
Guarantees citizens the right to form associations or unions.
Political parties are formed under this broader constitutional freedom.
Article 324:
Vests the superintendence, direction and control of elections in the Election Commission of India.
Article 326:
Provides for elections to the Lok Sabha and State Legislative Assemblies on the basis of adult suffrage.
Registration ≠ Recognition
Registration: A party gets registered with the ECI under Section 29A, RPA 1951.
Recognition: A registered party must additionally satisfy the electoral performance criteria under the Election Symbols Order, 1968.
BBC News Hindi की एक जाँच के अनुसार, गुजरात स्थित छः पंजीकृत गैर-मान्यता प्राप्त राजनीतिक दलों (RUPPs) को वर्ष 2023–24 में लगभग ₹1,700 करोड़ का चंदा प्राप्त हुआ।
यह राशि भाजपा को छोड़कर पाँच राष्ट्रीय दलों द्वारा प्राप्त कुल चंदे (₹1,480 करोड़) से अधिक थी।
इससे राजनीतिक दलों के वित्तीय पारदर्शिता, विनियमन, कर अपवंचन तथा संभावित धन-शोधन को लेकर चिंताएँ उत्पन्न हुई हैं।
Registered Unrecognised Political Parties (RUPPs) अर्थात पंजीकृत गैर-मान्यता प्राप्त राजनीतिक दल वे राजनीतिक दल हैं जो भारत निर्वाचन आयोग (ECI) के साथ पंजीकृत हैं, लेकिन उन्हें राष्ट्रीय दल या राज्य दल के रूप में मान्यता प्राप्त नहीं है।
लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 29A राजनीतिक दलों के निर्वाचन आयोग के साथ पंजीकरण का प्रावधान करती है।
पात्र राजनीतिक चंदे पर आयकर से छूट, विधि में निर्धारित शर्तों के अधीन।
लोकसभा/राज्य विधानसभा चुनावों में निर्धारित नियमों के अनुसार सामान्य चुनाव चिह्न प्राप्त करने की सुविधा।
चुनाव प्रचार के दौरान अधिकतम 20 स्टार प्रचारक रखने की सुविधा।
एक वित्तीय वर्ष में ₹20,000 से अधिक का व्यक्तिगत चंदा देने वाले दाताओं का विवरण रखना।
निर्धारित चंदा/योगदान संबंधी विवरण निर्वाचन आयोग को प्रस्तुत करना।
आवश्यक विवरण प्रस्तुत न करने पर कर छूट समाप्त हो सकती है।
निर्धारित सीमा से अधिक का चंदा चेक अथवा बैंक हस्तांतरण जैसे बैंकिंग माध्यमों से प्राप्त करना आवश्यक है।
भारत में RUPPs की संख्या बहुत अधिक है, लेकिन इनमें से बड़ी संख्या वास्तविक रूप से चुनाव नहीं लड़ती।
जुलाई 2025 तक देश में 2,800 से अधिक RUPPs थे।
इनमें से लगभग 750 दलों ने 2024 के लोकसभा चुनाव में भाग लिया।
केवल कागजों पर अस्तित्व रखने वाले ऐसे दलों को सामान्यतः “लेटर-पैड पार्टियाँ” कहा जाता है।
चिंता यह है कि कुछ निष्क्रिय दलों का उपयोग अपारदर्शी वित्तीय लेन-देन, कर अपवंचन तथा धन-शोधन के माध्यम के रूप में किया जा सकता है।
लोक प्रतिनिधित्व अधिनियम, 1951 के अंतर्गत निर्वाचन आयोग को किसी राजनीतिक दल के चुनाव न लड़ने या कुछ वैधानिक अनुपालनों में विफल रहने मात्र के आधार पर उसे पंजीकरण से हटाने की सामान्य शक्ति प्राप्त नहीं है।
Indian National Congress v. Institute of Social Welfare (2002) मामले में सर्वोच्च न्यायालय ने माना कि लोक प्रतिनिधित्व अधिनियम के अंतर्गत निर्वाचन आयोग के पास राजनीतिक दल का पंजीकरण रद्द करने की सामान्य शक्ति नहीं है।
हालाँकि, असाधारण परिस्थितियों में पंजीकरण समाप्त किया जा सकता है, जैसे:
पंजीकरण धोखाधड़ी के माध्यम से प्राप्त किया गया हो।
राजनीतिक दल ने संविधान के प्रति निष्ठा समाप्त कर दी हो।
सरकार द्वारा राजनीतिक दल को अवैध घोषित किया गया हो।
Association for Democratic Reforms (ADR) के अनुसार, वर्ष 2022–23 से संबंधित केवल लगभग 26% RUPPs की वार्षिक रिपोर्टें सार्वजनिक रूप से उपलब्ध थीं।
यह निम्न क्षेत्रों में महत्वपूर्ण कमी को दर्शाता है:
राजनीतिक वित्त का प्रकटीकरण
दाताओं की पारदर्शिता
वैधानिक अनुपालन
निर्वाचन आयोग की निगरानी
मुद्दा केवल राजनीतिक दलों के पंजीकरण का नहीं है, बल्कि राजनीतिक गतिविधियों की स्वतंत्रता और राजनीतिक वित्त में पारदर्शिता एवं जवाबदेही के बीच संतुलन स्थापित करने का है।
भारतीय संविधान राजनीतिक दलों को सीधे RUPP, राज्य दल या राष्ट्रीय दल के रूप में वर्गीकृत नहीं करता।
राजनीतिक दलों का पंजीकरण एवं मान्यता मुख्यतः:
लोक प्रतिनिधित्व अधिनियम, 1951
निर्वाचन चिह्न (आरक्षण एवं आवंटन) आदेश, 1968
के अंतर्गत विनियमित होती है।
पंजीकरण ≠ मान्यता
पंजीकरण:
राजनीतिक दल का भारत निर्वाचन आयोग के साथ पंजीकरण।
इसका आधार लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 29A है।
मान्यता:
पंजीकृत दल द्वारा निर्धारित निर्वाचन संबंधी प्रदर्शन मानदंड पूरा करने पर उसे राज्य दल या राष्ट्रीय दल के रूप में मान्यता मिलती है।
मान्यता के लिए मुख्य आधार निर्वाचन चिह्न (आरक्षण एवं आवंटन) आदेश, 1968 है।
मान्यता प्राप्त राजनीतिक दल दो प्रकार के होते हैं:
राज्य दल:
निर्धारित मत-प्रतिशत और/या सीट संबंधी मानदंड पूरा करने वाला दल, जिसे किसी राज्य में मान्यता प्राप्त होती है।
राष्ट्रीय दल:
विभिन्न राज्यों में निर्धारित निर्वाचन मानदंडों को पूरा करने वाला दल, जिसे राष्ट्रीय स्तर पर मान्यता प्राप्त होती है।
अनुच्छेद 19(1)(c):
नागरिकों को संघ या संगठन बनाने की स्वतंत्रता प्रदान करता है।
राजनीतिक दलों का गठन इस व्यापक संवैधानिक अधिकार के अंतर्गत आता है।
अनुच्छेद 324:
निर्वाचन आयोग को संसद तथा राज्य विधानमंडलों के चुनावों के संबंध में अधीक्षण, निर्देशन और नियंत्रण की शक्ति प्रदान करता है।
अनुच्छेद 326:
लोकसभा और राज्य विधानसभाओं के चुनावों को वयस्क मताधिकार के आधार पर कराने का प्रावधान करता है।
RUPP: निर्वाचन आयोग के साथ पंजीकृत, लेकिन राज्य या राष्ट्रीय दल के रूप में मान्यता प्राप्त नहीं।
मान्यता प्राप्त दल: पंजीकृत राजनीतिक दल जो निर्धारित निर्वाचन प्रदर्शन मानदंडों को पूरा करता है और जिसे राज्य दल या राष्ट्रीय दल के रूप में मान्यता प्राप्त है।
अतः प्रत्येक मान्यता प्राप्त राजनीतिक दल पंजीकृत होता है, लेकिन प्रत्येक पंजीकृत राजनीतिक दल मान्यता प्राप्त नहीं होता।
