  • Preservation of Religious Character (Section 4): The Act declares that the religious character of a place of worship as it existed on August 15, 1947, shall remain the same. There is a prohibition on converting a place of worship from one religion to another or from one sect to another.

अधिनियम की प्रमुख विशेषताएं:

  • धार्मिक चरित्र का संरक्षण (धारा 4): अधिनियम यह घोषित करता है कि 15 अगस्त, 1947 को किसी पूजा स्थल का जो धार्मिक चरित्र था, वह वैसा ही रहेगा। किसी भी पूजा स्थल को एक धर्म से दूसरे धर्म या एक संप्रदाय से दूसरे संप्रदाय के पूजा स्थल में बदलने पर प्रतिबंध है।
  • कानूनी कार्यवाही पर रोक: 15 अगस्त, 1947 तक मौजूद किसी भी पूजा स्थल के धार्मिक चरित्र को बदलने से संबंधित कोई भी लंबित मुकदमा या अपील इस कानून के लागू होने के साथ ही समाप्त (Abate) मानी जाएगी। भविष्य में भी ऐसी किसी भी मांग के लिए अदालत में नया मुकदमा दायर करने पर रोक है।
  • दंड का प्रावधान (धारा 6): यदि कोई व्यक्ति धारा 3 का उल्लंघन करता है (अर्थात पूजा स्थल को बदलने की कोशिश करता है), तो उसे 3 साल तक की कैद और जुर्माने की सजा हो सकती है। इसमें अपराध के लिए उकसाने या साजिश रचने वालों को भी दंडित किया जा सकता है।
  • अपवाद (Exceptions): * ऐतिहासिक स्मारक: यह कानून उन प्राचीन और ऐतिहासिक स्मारकों पर लागू नहीं होता जो ‘प्राचीन स्मारक और पुरातत्व स्थल और अवशेष अधिनियम, 1958’ के अंतर्गत आते हैं।
    • अयोध्या मामला: अधिनियम की धारा 5 में स्पष्ट रूप से उल्लेख किया गया है कि यह कानून ‘राम जन्मभूमि-बाबरी मस्जिद’ विवाद पर लागू नहीं होगा।
    • आपसी सहमति: यदि संबंधित पक्षों ने आपसी सहमति से किसी विवाद को सुलझा लिया है, तो यह अधिनियम वहां प्रभावी नहीं होता।
