Why in News?

On 12 August 2026, the report of the Inquiry Committee constituted under the Judges (Inquiry) Act, 1968 in the matter of Justice Yashwant Varma was laid before the Lok Sabha. The Committee found all three charges proved.

Background:

  • In the intervening night of 14–15 March 2025, a fire broke out at Justice Varma’s official residence in New Delhi, when he was a Judge of the Delhi High Court.

  • During firefighting, burnt, half-burnt and wet ₹500 currency notes were reportedly found in a storeroom.

  • The matter subsequently led to an in-house inquiry and a statutory inquiry under the Judges (Inquiry) Act, 1968.

Constitutional & Legal Framework:

Removal of a Supreme Court/High Court Judge

  • Article 124(4): Removal of a Supreme Court Judge.

  • Article 124(5): Parliament may regulate the procedure for investigation and proof of misbehaviour or incapacity.

  • Article 218: Extends the removal provisions of Article 124(4) and (5) to High Court Judges.

  • Judges (Inquiry) Act, 1968: Provides the statutory mechanism for investigation into alleged misbehaviour or incapacity.

Inquiry Committee:

The Committee consisted of:

  1. Justice Aravind Kumar, Supreme Court — Presiding Officer

  2. Justice Shree Chandrashekhar, Chief Justice, Bombay High Court

  3. B.V. Acharya, Senior Advocate

Key Findings:

1. Unexplained Currency:

  • Witnesses from Delhi Fire Services and Delhi Police reported seeing substantial quantities of ₹500 notes.

  • Photographs/videos were treated as corroborative evidence.

  • The exact amount could not be established because the currency was not seized, counted or inventoried.

  • However, the Committee held that the presence of substantial currency was established.

2. Evidence Not Preserved:

  • No proper seizure or inventory was made.

  • The storeroom was not adequately preserved as a crime/evidence scene.

  • The currency was subsequently not available for verification.

  • The Committee considered the failure to preserve material evidence significant.

3. Defence of Conspiracy:

  • A theory was advanced that the currency might have been planted.

  • The Committee found no concrete evidence identifying a person who planted the money or establishing an outside entry/conspiracy.

  • It therefore did not accept the conspiracy theory as a satisfactory explanation.

4. Explanations Found Unsatisfactory:

  • The Committee found the explanations offered by Justice Varma to be evasive, incomplete and misleading in effect.

  • It also noted that no defence witnesses were ultimately examined to substantiate relevant factual claims.

Important Procedural Point;

Justice Varma subsequently withdrew from participation in the proceedings. The Committee held that such withdrawal could not automatically terminate a statutory inquiry under the Judges (Inquiry) Act.

What Happens After an Inquiry Report?

A crucial exam point:

Inquiry Committee finding ≠ automatic removal of the Judge.

The report is part of the constitutional removal process. For removal, Parliament has a role under Article 124(4) read with Article 218, requiring an address by each House of Parliament supported by the constitutionally prescribed special majority, followed by the President’s order of removal.

12 अगस्त 2026 को न्यायमूर्ति यशवंत वर्मा से संबंधित जजेज़ (इन्क्वायरी) एक्ट, 1968 के तहत गठित जांच समिति की रिपोर्ट लोकसभा में रखी गई। समिति ने न्यायमूर्ति वर्मा के विरुद्ध लगाए गए तीनों आरोपों को सिद्ध माना।

पृष्ठभूमि

  • 14–15 मार्च 2025 की रात नई दिल्ली स्थित न्यायमूर्ति वर्मा के सरकारी आवास में आग लगी।

  • आग बुझाने के दौरान एक स्टोर रूम में जले, आधे-जले और गीले ₹500 के नोट मिलने की सूचना मिली।

संवैधानिक एवं कानूनी आधार

SC/HC के न्यायाधीश को हटाने की व्यवस्था

  • अनुच्छेद 124(4): सर्वोच्च न्यायालय के न्यायाधीश को हटाने की प्रक्रिया।

  • अनुच्छेद 124(5): संसद को न्यायाधीश के दुर्व्यवहार या अक्षमता की जांच एवं प्रमाण की प्रक्रिया निर्धारित करने की शक्ति।

प्रमुख निष्कर्ष

1. अज्ञात नकदी की मौजूदगी

  • दिल्ली फायर सर्विस और दिल्ली पुलिस के कई अधिकारियों ने बड़ी मात्रा में ₹500 के नोट देखने की बात कही।

  • फोटो एवं वीडियो को सहायक साक्ष्य माना गया।

  • नकदी की सटीक राशि निर्धारित नहीं हो सकी, क्योंकि उसे जब्त, गिना या सूचीबद्ध नहीं किया गया था।

  • फिर भी समिति ने माना कि बड़ी मात्रा में नकदी की मौजूदगी सिद्ध हुई।

2. साक्ष्य सुरक्षित नहीं रखा गया

  • उचित जब्ती एवं इन्वेंटरी नहीं बनाई गई।

  • स्टोर रूम को पर्याप्त रूप से सुरक्षित नहीं किया गया।

  • बाद में नकदी उपलब्ध नहीं रही, जिससे उसका स्वतंत्र सत्यापन संभव नहीं हुआ।

  • समिति ने इसे महत्वपूर्ण प्रक्रियात्मक कमी माना।

3. साजिश/नकदी रखे जाने का बचाव

  • यह तर्क दिया गया कि नकदी किसी साजिश के तहत रखी गई हो सकती है।

  • समिति को ऐसा कोई ठोस साक्ष्य नहीं मिला जिससे यह साबित हो कि किसी व्यक्ति ने नकदी रखी या कोई बाहरी व्यक्ति परिसर में आया था।

  • इसलिए साजिश का दावा पर्याप्त स्पष्टीकरण नहीं माना गया।

4. स्पष्टीकरण असंतोषजनक

  • समिति के अनुसार दिए गए स्पष्टीकरण टालमटोलपूर्ण, अपूर्ण और प्रभावतः भ्रामक थे।

  • संबंधित दावों के समर्थन में कोई रक्षा गवाह अंततः पेश नहीं किया गया।

न्यायमूर्ति वर्मा का कार्यवाही से हटना

न्यायमूर्ति वर्मा ने बाद में जांच की कार्यवाही से हटने की सूचना दी। समिति ने माना कि किसी पक्ष का एकतरफा रूप से कार्यवाही से हटना Judges (Inquiry) Act, 1968 के तहत चल रही वैधानिक जांच को स्वतः समाप्त नहीं करता।

रिपोर्ट के बाद क्या होगा?

महत्वपूर्ण परीक्षा बिंदु:
जांच समिति द्वारा आरोप सिद्ध होना = न्यायाधीश का स्वतः पद से हटना नहीं।

न्यायाधीश को हटाने के लिए:

जांच समिति की रिपोर्ट → संसद में विचार → दोनों सदनों में संवैधानिक प्रक्रिया के अनुसार विशेष बहुमत → राष्ट्रपति का हटाने का आदेश

यह प्रक्रिया अनुच्छेद 124(4) एवं 218 के संवैधानिक ढांचे से जुड़ी है।
