Historical Background:

Foreign Contribution (Regulation) Act, 1976:

  • Enacted during the Emergency (1975–77).

  • Focused mainly on political parties, election candidates, journalists, judges, government servants and organisations receiving foreign donations.

FCRA, 2010:

  • The 1976 Act was repealed and replaced by the Foreign Contribution (Regulation) Act, 2010.

  • Why was a new Act needed?

    • Regulate increasing foreign donations to NGOs.

Constitutional Background:

What is Foreign Contribution?

Under Section 2 of FCRA, foreign contribution includes:

  • Types of assets: Foreign currency, foreign securities, and articles (except personal gifts below a prescribed value).

  • Sources: Received from foreign governments, foreign companies, international agencies, foreign citizens, and foreign trusts or foundations.

Objectives and Administration of FCRA

Objectives

Important 2020 Amendment:

  • Reduced Administrative Expenses: Capped from 50% down to 20% of the foreign contribution.

  • Ban on Transfer: NGOs cannot transfer foreign contributions to another NGO.

  • Aadhaar Requirement: Office bearers must furnish [Aadhaar Redacted] (or a passport for foreigners).

Foreign Contribution (Regulation) Amendment Bill, 2026:

Objective

To strengthen control over foreign-funded assets and improve financial accountability.

Major Provisions:

  1. Designated Authority: A new authority will manage foreign contributions and foreign-funded assets when registration is cancelled, surrendered, expired, or not renewed.

  2. Government Control over Assets: If registration is not restored, the government may transfer assets to government departments or sell them. Sale proceeds will go to the Consolidated Fund of India (CFI).

  3. New Section 14B (“Deemed Cessation”): Registration automatically ends if renewal is not applied for, renewal is rejected, or validity expires without renewal.

  4. Time-bound Utilisation: Imposes mandatory timelines for the receipt and utilisation of foreign contributions to improve financial discipline.

  5. Restrictions During Suspension: During suspension, an organisation cannot sell, mortgage, or transfer assets without government approval.

  6. Centralised Investigation: State governments or investigation agencies must obtain the prior approval of the Central Government before initiating FCRA-related investigations.

  7. Reduced Penalties: Maximum punishment reduced from 5 years to 1 year, or a fine, or both.

  8. Individual Accountability: Definition of “Key Functionary” expanded to include directors, trustees, partners, office bearers, Kartas (HUF), and any person controlling management (personal liability applies unless due diligence is proven).

  9. Permanent Vesting of Assets: If an NGO ceases to exist, its foreign-funded assets permanently vest in the government through the Designated Authority.

विदेशी अंशदान (विनिमय) अधिनियम, 1976:

  • अलग एफसीआरए बैंक खाता: अनिवार्य एफसीआरए खाता। 2020 से, सभी विदेशी अंशदान हस्तांतरण से पहले भारतीय स्टेट बैंक (SBI), नई दिल्ली मुख्य शाखा में ही प्राप्त किए जाने चाहिए।

महत्वपूर्ण 2020 संशोधन (यूपीएससी का पसंदीदा):

  • प्रशासनिक खर्चों में कटौती: विदेशी अंशदान के 50% से घटाकर 20% कर दिया गया।

  • हस्तांतरण पर प्रतिबंध: एनजीओ विदेशी अंशदान को किसी अन्य एनजीओ को हस्तांतरित नहीं कर सकते।

  • आधार की अनिवार्यता: पदाधिकारियों को आधार [आधार संवेदनशील डेटा छुपाया गया] (या विदेशियों के लिए पासपोर्ट) प्रदान करना होगा।

  • एसबीआई नई दिल्ली खाता अनिवार्य: विदेशी धन की केंद्रीकृत निगरानी।

विदेशी अंशदान (विनिमय) संशोधन विधेयक, 2026:

उद्देश्य:

विदेशी वित्तपोषित संपत्तियों पर नियंत्रण मजबूत करना और वित्तीय जवाबदेही में सुधार करना।

प्रमुख प्रावधान:

  1. नामित प्राधिकारी (Designated Authority): जब पंजीकरण रद्द, सरेंडर, समाप्त या अनवीनीकृत हो जाता है, तो विदेशी अंशदान और विदेशी-वित्तपोषित संपत्तियों के प्रबंधन के लिए एक नया प्राधिकारी होगा।

  5. निलंबन के दौरान प्रतिबंध: निलंबन की अवधि के दौरान, कोई संगठन सरकार की पूर्व अनुमति के बिना संपत्तियों को बेच, गिरवी या हस्तांतरित नहीं कर सकता है।

  6. केंद्रीकृत जांच: राज्य सरकारों या जांच एजेंसियों को एफसीआरए से संबंधित जांच शुरू करने से पहले केंद्र सरकार की पूर्व अनुमति प्राप्त करनी होगी।

  7. घटित दंड: अधिकतम सजा 5 वर्ष से घटाकर 1 वर्ष या जुर्माना, या दोनों कर दी गई है।

  8. व्यक्तिगत जवाबदेही: “प्रमुख पदाधिकारी” (Key Functionary) की परिभाषा का दायरा बढ़ाकर इसमें निदेशक, ट्रस्टी, पार्टनर, पदाधिकारी, कर्ता (HUF) और प्रबंधन को नियंत्रित करने वाले किसी भी व्यक्ति को शामिल किया गया है (जब तक कि उचित परिश्रम/Due Diligence साबित न हो, व्यक्तिगत देनदारी लागू होगी)।

  9. संपत्तियों का स्थायी निहितीकरण: यदि कोई एनजीओ अस्तित्व में नहीं रहता है, तो उसकी विदेशी वित्तपोषित संपत्तियां नामित प्राधिकारी के माध्यम से स्थायी रूप से सरकार में निहित हो जाएंगी।

विनियमन आवश्यक क्यों है?:
