Why in News?

Rajya Sabha MP Raghav Chadha was removed from the Punjab draft electoral roll during the ongoing Special Intensive Revision (SIR) and has now been included in the Delhi electoral roll. AAP has questioned the procedure, while the Delhi CEO says electoral-roll additions/deletions are being processed under the prescribed legal framework.

Electoral Roll = Voter List

  • A person can ordinarily be registered as a voter in only one constituency at a time.

  • If a person shifts their ordinary residence from Punjab to Delhi, their name can be shifted from the Punjab roll and included in the Delhi roll, subject to the prescribed procedure.

Constitutional Provisions:

Article 324 — Election Commission:

  • Gives the Election Commission of India (ECI) superintendence, direction and control over elections.

  • ECI supervises the preparation and revision of electoral rolls.

Article 325 — One General Electoral Roll:

  • There shall be one general electoral roll for every territorial constituency.

  • No person can be excluded from an electoral roll only on the grounds of religion, race, caste or sex.

Article 326 — Universal Adult Suffrage:

  • Elections to Lok Sabha and State Legislative Assemblies are based on adult suffrage.

  • Citizens meeting the legal requirements can be registered as electors.

Important: The Constitution provides the broad framework, while the actual procedure for addition, deletion and shifting of names is mainly governed by the Representation of the People Act, 1950 and related rules.

Representation of the People Act, 1950:

Section 17 — No Registration in More Than One Constituency:

  • A person cannot be registered as an elector in more than one constituency.

Section 18 — No Multiple Registration:

  • A person cannot be registered more than once in the same constituency.

Section 19 — Conditions for Registration:

  • A person must be 18 years or above.

  • The person must be ordinarily resident in the concerned constituency.

Section 22 — Deletion/Correction:

  • Electoral authorities can correct or delete an entry in specified circumstances.

  • This includes cases where a person is not entitled to be registered or has ceased to be ordinarily resident.

Section 23 — Inclusion of Name:

  • A person whose name is missing from the electoral roll can apply for inclusion, subject to eligibility and verification.

Chadha Case — What is the Actual Issue?

The controversy is not simply whether a voter can shift from Punjab to Delhi.

The important issue is:

Whether his name was deleted from Punjab and subsequently added to Delhi following the prescribed procedure and proper verification.

His Punjab electoral-roll entry was reportedly marked as “shifted” during the SIR, while his name was subsequently included in the Delhi electoral roll.

 चर्चा में क्यों ?

राज्यसभा सांसद राघव चड्ढा का नाम पंजाब की ड्राफ्ट मतदाता सूची से चल रहे विशेष गहन पुनरीक्षण (SIR) के दौरान हटाया गया और बाद में उनका नाम दिल्ली की मतदाता सूची में शामिल किया गया। इस प्रक्रिया को लेकर राजनीतिक विवाद हुआ है।

पहले मूल बात समझें:

Electoral Roll = मतदाता सूची

  • सामान्यतः कोई व्यक्ति एक समय में केवल एक निर्वाचन क्षेत्र की मतदाता सूची में पंजीकृत हो सकता है।

  • यदि व्यक्ति अपना सामान्य निवास (Ordinarily Resident) पंजाब से दिल्ली स्थानांतरित करता है, तो निर्धारित प्रक्रिया के अनुसार पंजाब की सूची से नाम हटाकर दिल्ली की सूची में जोड़ा जा सकता है।

संवैधानिक प्रावधान:

अनुच्छेद 324 — निर्वाचन आयोग:

  • भारत निर्वाचन आयोग (ECI) को चुनावों के अधीक्षण, निर्देशन और नियंत्रण की शक्ति देता है।

  • निर्वाचन आयोग मतदाता सूचियों के निर्माण और पुनरीक्षण की निगरानी करता है।

अनुच्छेद 325 — एक सामान्य मतदाता सूची:

  • प्रत्येक क्षेत्रीय निर्वाचन क्षेत्र के लिए एक सामान्य मतदाता सूची होगी।

  • किसी व्यक्ति को केवल धर्म, मूलवंश, जाति या लिंग के आधार पर मतदाता सूची से बाहर नहीं किया जा सकता।

अनुच्छेद 326 — वयस्क मताधिकार:

  • लोकसभा और राज्य विधानसभाओं के चुनाव वयस्क मताधिकार के आधार पर होते हैं।

  • कानूनी पात्रता पूरी करने वाला नागरिक मतदाता के रूप में पंजीकृत हो सकता है।

महत्वपूर्ण: संविधान केवल व्यापक ढाँचा देता है। मतदाता सूची में नाम जोड़ने, हटाने और स्थानांतरित करने की विस्तृत प्रक्रिया मुख्यतः जन प्रतिनिधित्व अधिनियम, 1950 तथा संबंधित नियमों में दी गई है।

जन प्रतिनिधित्व अधिनियम, 1950:

धारा 17 — एक से अधिक निर्वाचन क्षेत्रों में पंजीकरण नहीं:

  • कोई व्यक्ति एक से अधिक निर्वाचन क्षेत्रों में मतदाता के रूप में पंजीकृत नहीं हो सकता।

धारा 18 — एक ही निर्वाचन क्षेत्र में दोहरा पंजीकरण नहीं:

  • किसी व्यक्ति का नाम एक ही निर्वाचन क्षेत्र में एक से अधिक बार दर्ज नहीं हो सकता।

धारा 19 — पंजीकरण की शर्तें:

  • व्यक्ति की आयु 18 वर्ष या अधिक होनी चाहिए।

  • वह संबंधित निर्वाचन क्षेत्र में सामान्य रूप से निवास करने वाला (Ordinarily Resident) होना चाहिए।

धारा 22 — नाम हटाना/सुधार:

  • निर्धारित परिस्थितियों में निर्वाचन अधिकारी किसी प्रविष्टि को सुधार या हटा सकता है।

  • उदाहरण: व्यक्ति अब उस निर्वाचन क्षेत्र का सामान्य निवासी नहीं है

धारा 23 — नाम शामिल करना:

  • पात्र व्यक्ति मतदाता सूची में अपना नाम शामिल कराने के लिए आवेदन कर सकता है।

  • पात्रता और आवश्यक सत्यापन के बाद नाम जोड़ा जा सकता है।

महत्वपूर्ण फॉर्म:

चड्ढा मामले में वास्तविक मुद्दा:

विवाद केवल यह नहीं है कि पंजाब से दिल्ली मतदाता पंजीकरण स्थानांतरित किया जा सकता है या नहीं।

मुख्य प्रश्न है:

क्या पंजाब से नाम हटाने और दिल्ली में नाम जोड़ने की पूरी प्रक्रिया निर्धारित नियमों और उचित सत्यापन के अनुसार हुई?
