Why in News?

  • Union Home Minister Amit Shah has set 31 December 2029 as the target to eliminate the drug trade from India through coordinated enforcement and intelligence-based action.

  • He was addressing the third National Conference of Heads of Anti-Narcotics Task Force (ANTF) of States and Union Territories in New Delhi.

  • The two-day conference was organised by the Narcotics Control Bureau (NCB) and attended by ANTF heads from 36 States and Union Territories.

Shift in India’s Anti-Narcotics Strategy:

  • The approach is proposed to move from a “seizure-centric” model to dismantling entire drug-trafficking networks.

  • The focus will be on identifying and disrupting the complete trafficking chain, from production and entry into India to distribution and local sale.

  • Greater emphasis will be placed on:

    • Financial investigation and tracing proceeds of drug trafficking.

    • Tracking digital links used by trafficking networks.

    • Targeting the profits and financial infrastructure of drug cartels.

    • Converting intelligence inputs into actionable intelligence.

Three-Level Targeting of Drug Networks:

  • Entry/Production Level: Targeting drug manufacturing centres and points through which narcotics enter India.

  • Inter-State Distribution Level: Disrupting transportation corridors and networks connecting different States.

  • Local Distribution Level: Breaking district-level networks involved in the sale and distribution of drugs.

District-Based Classification:

Districts will be categorised according to their role in the narcotics ecosystem:

  • Production/Entry Districts: Areas where drugs are produced or enter the country.

  • Transit Districts: Areas functioning as transportation and trafficking corridors.

  • Consumption Districts: Areas where drug consumption is prevalent.

Focus on International Drug Traffickers:

  • Agencies have been directed to strengthen action against foreign nationals involved in drug trafficking.

  • Such individuals are to be deported and prevented from re-entering India, wherever legally applicable.

  • Fugitive traffickers operating from abroad should be identified, apprehended and brought before Indian courts through appropriate legal and international cooperation mechanisms.

Legal and Investigative Measures:

  • Greater utilisation of the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988 (PITNDPS Act) was emphasised.

  • Agencies have been asked to develop a comprehensive investigation-to-conviction roadmap in coordination with public prosecutors.

  • Enforcement agencies must identify and plug loopholes along international borders and drug-production centres.

  • Strengthening the link between investigation, prosecution and conviction is essential for effective enforcement.

Role of ANTFs:

  • State and Union Territory Anti-Narcotics Task Forces are expected to function as key pillars of coordinated anti-drug enforcement.

  • Intelligence sharing should become an integral part of policing.

चर्चा में क्यों?

  • केंद्रीय गृह मंत्री अमित शाह ने समन्वित प्रवर्तन तथा आसूचना-आधारित कार्रवाई के माध्यम से भारत से मादक पदार्थों के अवैध व्यापार को समाप्त करने के लिए 31 दिसंबर 2029 की समय-सीमा निर्धारित की है।

  • उन्होंने नई दिल्ली में राज्यों एवं संघ राज्य क्षेत्रों के मादक पदार्थ-विरोधी कार्यबल (ANTF) के प्रमुखों के तीसरे राष्ट्रीय सम्मेलन को संबोधित किया।

  • दो दिवसीय सम्मेलन का आयोजन स्वापक नियंत्रण ब्यूरो (Narcotics Control Bureau—NCB) द्वारा किया गया, जिसमें 36 राज्यों एवं संघ राज्य क्षेत्रों के ANTF प्रमुखों ने भाग लिया।

भारत की स्वापक-विरोधी रणनीति में परिवर्तन:

    • मादक पदार्थ कार्टेल के लाभ तथा वित्तीय संरचना को लक्षित करने पर।

मादक पदार्थ नेटवर्क को लक्षित करने के तीन स्तर:

  • प्रवेश/उत्पादन स्तर: मादक पदार्थों के निर्माण केंद्रों तथा भारत में उनके प्रवेश के मार्गों को लक्षित करना।

  • अंतर्राज्यीय वितरण स्तर: विभिन्न राज्यों को जोड़ने वाले परिवहन मार्गों एवं तस्करी नेटवर्क को बाधित करना।

  • स्थानीय वितरण स्तर: मादक पदार्थों की बिक्री एवं वितरण में संलिप्त जिला-स्तरीय नेटवर्क को समाप्त करना।

जिला-आधारित वर्गीकरण:

मादक पदार्थों के पारिस्थितिकी तंत्र में उनकी भूमिका के आधार पर जिलों का वर्गीकरण किया जाएगा:

  • उत्पादन/प्रवेश जिले: जहाँ मादक पदार्थों का उत्पादन होता है अथवा वे देश में प्रवेश करते हैं।

  • पारगमन जिले: जो मादक पदार्थों के परिवहन एवं तस्करी के मार्ग के रूप में कार्य करते हैं।

  • उपभोग जिले: जहाँ मादक पदार्थों का सेवन अपेक्षाकृत अधिक प्रचलित है।

अंतरराष्ट्रीय मादक पदार्थ तस्करों पर ध्यान:

  • मादक पदार्थों की तस्करी में संलिप्त विदेशी नागरिकों के विरुद्ध कार्रवाई को सुदृढ़ करने का निर्देश दिया गया है।

  • जहाँ विधि द्वारा अनुमत हो, ऐसे व्यक्तियों को निर्वासित (deport) करने तथा उनके भारत में पुनः प्रवेश को रोकने की कार्रवाई की जाएगी।

  • विदेशों से सक्रिय भगोड़े तस्करों की पहचान कर उन्हें गिरफ्तार करने तथा उपयुक्त विधिक एवं अंतरराष्ट्रीय सहयोग तंत्र के माध्यम से भारतीय न्यायालयों के समक्ष प्रस्तुत करने पर बल दिया गया है।

विधिक एवं अन्वेषणात्मक उपाय:

  • स्वापक औषधि और मन:प्रभावी पदार्थों के अवैध व्यापार की रोकथाम अधिनियम, 1988 (PITNDPS Act) के अधिक प्रभावी उपयोग पर बल दिया गया है।

  • अभियोजन अधिकारियों के साथ समन्वय करते हुए अन्वेषण से दोषसिद्धि तक की व्यापक कार्ययोजना विकसित करने पर जोर दिया गया है।

  • प्रवर्तन एजेंसियों को अंतरराष्ट्रीय सीमाओं तथा मादक पदार्थ उत्पादन केंद्रों पर विद्यमान कमियों एवं विधिक/प्रवर्तन संबंधी छिद्रों की पहचान कर उन्हें दूर करना होगा।

  • प्रभावी प्रवर्तन के लिए अन्वेषण, अभियोजन एवं दोषसिद्धि के बीच बेहतर समन्वय आवश्यक है।

ANTF की भूमिका:

  • राज्यों एवं संघ राज्य क्षेत्रों के मादक पदार्थ-विरोधी कार्यबल (ANTF) को समन्वित मादक पदार्थ-विरोधी प्रवर्तन के प्रमुख स्तंभ के रूप में कार्य करना अपेक्षित है।

  • आसूचना-साझाकरण को पुलिसिंग का अभिन्न अंग बनाया जाना चाहिए।

  • कच्ची सूचना को कार्रवाई योग्य आसूचना में परिवर्तित कर समन्वित अभियानों में उपयोग करने पर बल दिया गया है।

  • मादक पदार्थ तस्करी नेटवर्क प्रायः विभिन्न अधिकार-क्षेत्रों में सक्रिय रहते हैं; अतः अंतर्राज्यीय एवं अंतर-एजेंसी समन्वय को सुदृढ़ करना आवश्यक है।

महत्त्व:

  • यह दृष्टिकोण व्यक्तिगत जब्ती एवं प्रकरण-केंद्रित प्रवर्तन से आगे बढ़कर संपूर्ण नेटवर्क के विघटन पर केंद्रित है।

  • वित्तीय प्रवाह को लक्षित करने से मादक पदार्थ कार्टेल की आर्थिक आधारभूत संरचना कमजोर की जा सकती है।

  • जिला-स्तरीय वर्गीकरण से क्षेत्र-विशिष्ट मादक पदार्थ-विरोधी रणनीतियाँ विकसित करने में सहायता मिलेगी।

  • अन्वेषण एजेंसियों एवं अभियोजन अधिकारियों के मध्य बेहतर समन्वय से दोषसिद्धि-केंद्रित प्रवर्तन को सुदृढ़ किया जा सकता है।

  • सीमा-पार तस्करी तथा विदेशों में सक्रिय भगोड़े तस्करों से निपटने के लिए अंतरराष्ट्रीय सहयोग आवश्यक है।

प्रमुख चुनौतियाँ:

  • संगठित मादक पदार्थ तस्करी का सीमा-पार स्वरूप

  • तस्करी नेटवर्क द्वारा डिजिटल प्लेटफॉर्म एवं कूटबद्ध संचार का उपयोग।

  • जटिल एवं छिपे हुए वित्तीय लेन-देन

  • अनेक केंद्रीय, राज्य एवं अंतरराष्ट्रीय एजेंसियों के मध्य समन्वय संबंधी कठिनाइयाँ

  • प्रवर्तन उपायों के अनुरूप मादक पदार्थ नेटवर्क द्वारा शीघ्र रणनीतिक अनुकूलन

  • अन्वेषण, साक्ष्य-संग्रह एवं अभियोजन से संबंधित कठिनाइयों के कारण दोषसिद्धि सुनिश्चित करने में चुनौती।

आगे की राह:

  • आसूचना-आधारित एवं प्रौद्योगिकी-सक्षम पुलिसिंग को सुदृढ़ किया जाए।

  • वित्तीय, डिजिटल एवं भौतिक अन्वेषण को एकीकृत करने के लिए समन्वित अन्वेषण तंत्र विकसित किया जाए।

  • NCB, राज्य ANTF, सीमा-प्रवर्तन एजेंसियों, पुलिस एवं अभियोजन प्राधिकारियों के मध्य समन्वय बढ़ाया जाए।

  • प्रत्यर्पण, निर्वासन तथा अंतरराष्ट्रीय तस्करी नेटवर्क के अन्वेषण हेतु अंतरराष्ट्रीय विधिक सहयोग को मजबूत किया जाए।

  • उत्पादन, पारगमन एवं उपभोग के स्वरूप के आधार पर जिला-विशिष्ट रणनीतियाँ अपनाई जाएँ।

  • आपूर्ति में कमी, मांग में कमी, पुनर्वास एवं निवारण पर एक साथ ध्यान दिया जाए।
