The Ministry of Home Affairs (MHA) has extended the Armed Forces (Special Powers) Act, 1958 (AFSPA) for another six months from October 1, 2026 in parts of Manipur, Nagaland and Arunachal Pradesh.
The Armed Forces (Special Powers) Act, 1958 was enacted to empower the armed forces to operate effectively in areas declared “disturbed” due to insurgency or serious internal security challenges.
After an area is declared disturbed under Section 3, armed forces personnel may, subject to statutory conditions:
Use force, including lethal force, against persons violating prohibitory orders.
Arrest without warrant.
Enter and search premises without warrant.
Destroy certain structures used for insurgent activities, subject to the Act.
Section 7: No prosecution or legal proceedings against personnel for acts done under AFSPA can be initiated without prior sanction of the Central Government.
This protection, along with the extensive operational powers, remains a major source of debate.
Under Section 3:
Central Government, or
State Government
can declare an area as a “disturbed area”.
Manipur:
AFSPA extended across the State, except 13 police-station jurisdictions in five Valley districts.
The May 2023 ethnic conflict reversed the earlier trend of AFSPA withdrawal.
Nagaland:
Extended in 9 districts and areas under 21 police stations in 5 other districts.
Continuation is linked to insurgent activity and the unresolved Naga political issue.
Arunachal Pradesh:
Extended in Tirap, Changlang and Longding districts.
Also applicable to specified police-station areas in Namsai district bordering Assam.
1981: AFSPA came into operation in Manipur.
2004: Withdrawn from Imphal municipal area.
2022–April 2023: Gradual withdrawal from all Valley police-station areas due to improved security conditions.
May 2023: Ethnic violence reversed the withdrawal process.
November 2024: MHA reimposed AFSPA in six police-station areas across five districts.
Insurgency and armed-group activity.
Difficult terrain and porous inter-State/international borders.
Need for coordinated counter-insurgency operations.
In Nagaland, continuation is also associated with the Naga peace process.
In Arunachal Pradesh, application is concentrated in areas affected by insurgent movement and adjoining Assam.
Human rights concerns: Possibility of excessive or disproportionate use of force.
Accountability: Prior Central sanction can make prosecution difficult.
Civil–military balance: Extensive military powers may affect normal policing.
Public trust: Prolonged application may create alienation among local communities.
Federal concerns: Differences may arise between Central and State governments over its application.
Provides operational flexibility in high-risk insurgency situations.
Enables rapid action where ordinary policing may be inadequate.
Supports protection of civilians and critical infrastructure.
Provides legal certainty to personnel operating in exceptional security conditions.
Apply AFSPA on the basis of objective and periodically reviewed security indicators.
Ensure proportionality, necessity and minimum use of force.
Strengthen independent investigation of alleged violations.
Improve civil–military and Centre–State coordination.
Accelerate peace negotiations and political dialogue.
Strengthen local police and intelligence capacity.
Ensure greater transparency and public communication regarding disturbed-area notifications.
Pursue a calibrated transition from military-led security to normal civilian policing as conditions improve.
AFSPA represents a difficult balance between national security and civil liberties. Its continuation should therefore remain security-driven, proportionate, accountable and subject to periodic review, with the long-term objective of restoring normal civilian administration and policing.

गृह मंत्रालय (MHA) ने सशस्त्र बल (विशेष शक्तियाँ) अधिनियम, 1958 (AFSPA) को 1 अक्टूबर 2026 से छह माह के लिए मणिपुर, नागालैंड और अरुणाचल प्रदेश के कुछ क्षेत्रों में विस्तारित किया है।
सशस्त्र बल (विशेष शक्तियाँ) अधिनियम, 1958 का उद्देश्य उग्रवाद अथवा गंभीर आंतरिक सुरक्षा चुनौतियों के कारण “अशांत” घोषित क्षेत्रों में सशस्त्र बलों को प्रभावी ढंग से कार्य करने हेतु विशेष शक्तियाँ प्रदान करना है।
धारा 3 के तहत किसी क्षेत्र को अशांत घोषित किए जाने के बाद सशस्त्र बलों को कानून में निर्धारित शर्तों के अधीन:
निषेधाज्ञा का उल्लंघन करने वाले व्यक्तियों के विरुद्ध बल, जिसमें घातक बल भी शामिल है, का प्रयोग करने की शक्ति।
बिना वारंट गिरफ्तारी।
बिना वारंट प्रवेश एवं तलाशी।
उग्रवादी गतिविधियों में प्रयुक्त कुछ संरचनाओं को नष्ट करने की शक्ति।
धारा 7: AFSPA के अंतर्गत किए गए कार्यों के संबंध में किसी सैन्यकर्मी के विरुद्ध अभियोजन या अन्य कानूनी कार्यवाही शुरू करने के लिए केंद्र सरकार की पूर्व स्वीकृति आवश्यक है।
यही कानूनी संरक्षण तथा व्यापक परिचालन शक्तियाँ AFSPA को विवादास्पद बनाती हैं।
धारा 3 के तहत:
केंद्र सरकार, अथवा
राज्य सरकार
किसी क्षेत्र को “अशांत क्षेत्र” घोषित कर सकती है।
मणिपुर:
पूरे राज्य में AFSPA लागू, पाँच घाटी जिलों के 13 पुलिस थाना क्षेत्रों को छोड़कर।
मई 2023 के जातीय संघर्ष ने AFSPA हटाने की पूर्व प्रक्रिया को उलट दिया।
नागालैंड:
9 जिलों तथा 5 अन्य जिलों के 21 पुलिस थाना क्षेत्रों में विस्तार।
उग्रवादी गतिविधियों एवं लंबित नगा राजनीतिक मुद्दे से इसका निरंतर संबंध रहा है।
अरुणाचल प्रदेश:
तिरप, चांगलांग और लोंगडिंग जिलों में लागू।
असम की सीमा से लगे नामसाई जिले के कुछ पुलिस थाना क्षेत्रों में भी लागू।
1981: मणिपुर में AFSPA लागू।
2004: इम्फाल नगरपालिका क्षेत्र से हटाया गया।
2022–अप्रैल 2023: सुरक्षा स्थिति में सुधार के आधार पर घाटी के सभी पुलिस थाना क्षेत्रों से क्रमिक रूप से हटाया गया।
मई 2023: जातीय हिंसा के बाद स्थिति में परिवर्तन।
नवंबर 2024: पाँच जिलों के छह पुलिस थाना क्षेत्रों में पुनः लागू किया गया।
उग्रवाद एवं सशस्त्र समूहों की गतिविधियाँ।
कठिन भौगोलिक क्षेत्र तथा संवेदनशील सीमाएँ।
प्रभावी उग्रवाद-रोधी अभियानों के लिए परिचालन क्षमता।
नागालैंड में लंबित नगा शांति प्रक्रिया।
अरुणाचल प्रदेश में उग्रवादी गतिविधियों से प्रभावित तथा असम से लगे क्षेत्र।
मानवाधिकार: बल के अत्यधिक अथवा अनुपातहीन प्रयोग की संभावना।
जवाबदेही: अभियोजन के लिए पूर्व केंद्रीय स्वीकृति की आवश्यकता।
नागरिक-सैन्य संतुलन: व्यापक सैन्य शक्तियाँ सामान्य पुलिस व्यवस्था को प्रभावित कर सकती हैं।
जनविश्वास: लंबे समय तक लागू रहने से स्थानीय समुदायों में असंतोष उत्पन्न हो सकता है।
संघीय मुद्दे: केंद्र एवं राज्य सरकारों के बीच AFSPA लागू करने को लेकर मतभेद संभव।
गंभीर उग्रवादी परिस्थितियों में त्वरित एवं प्रभावी कार्रवाई की सुविधा।
सामान्य पुलिस व्यवस्था की सीमाओं वाले क्षेत्रों में परिचालन लचीलापन।
नागरिकों एवं महत्वपूर्ण अवसंरचना की सुरक्षा में सहायता।
असाधारण सुरक्षा परिस्थितियों में सशस्त्र बलों के लिए कानूनी स्पष्टता।
वस्तुनिष्ठ सुरक्षा मानकों के आधार पर AFSPA की नियमित समीक्षा।
बल प्रयोग में आवश्यकता, आनुपातिकता एवं न्यूनतम बल के सिद्धांतों का पालन।
कथित उल्लंघनों की स्वतंत्र एवं निष्पक्ष जाँच।
नागरिक–सैन्य एवं केंद्र–राज्य समन्वय को मजबूत करना।
शांति वार्ता एवं राजनीतिक संवाद को गति देना।
स्थानीय पुलिस की क्षमता एवं खुफिया तंत्र को मजबूत करना।
अशांत क्षेत्र संबंधी अधिसूचनाओं में पारदर्शिता एवं सार्वजनिक संवाद बढ़ाना।
सुरक्षा स्थिति में सुधार के साथ सैन्य-केंद्रित व्यवस्था से सामान्य नागरिक पुलिस व्यवस्था की ओर क्रमिक संक्रमण।
AFSPA राष्ट्रीय सुरक्षा एवं नागरिक स्वतंत्रताओं के बीच संतुलन का प्रश्न प्रस्तुत करता है। अतः इसका प्रयोग सुरक्षा-आधारित, आनुपातिक, जवाबदेह एवं समय-समय पर समीक्षा योग्य होना चाहिए तथा दीर्घकालिक लक्ष्य सामान्य नागरिक प्रशासन एवं पुलिस व्यवस्था की पुनर्स्थापना होना चाहिए।
“AFSPA एक असाधारण सुरक्षा उपाय के रूप में अभिकल्पित है, किंतु इसके दीर्घकालिक प्रयोग से जवाबदेही एवं नागरिक स्वतंत्रताओं से संबंधित चिंताएँ उत्पन्न होती हैं।” चर्चा कीजिए।
