Tommy Koh, Singaporean lawyer, diplomat and legal scholar, was among the Ramon Magsaysay Award 2026 recipients. He played a pivotal role in the Third United Nations Conference on the Law of the Sea (UNCLOS III) and helped steer more than 150 countries towards the adoption of UNCLOS in 1982.

One of the most difficult issues during UNCLOS negotiations concerned Part XI, dealing with the deep seabed.
UNCLOS treats the deep seabed beyond national jurisdiction and its resources as the common heritage of mankind.

Their exploitation must be governed internationally.
Benefits should be shared according to the international regime.
The Reagan Administration objected to aspects of Part XI because it considered the original seabed-mining regime inconsistent with:

The 1994 Agreement relating to Part XI subsequently modified the seabed-mining regime to address several concerns.
However, the United States has still not ratified UNCLOS.

Even though the United States is not a party, it considers UNCLOS an authoritative framework for the law of the sea.

UNCLOS recognises transit passage through straits used for international navigation.

Iran is not a party to UNCLOS.
However, the principle of transit passage is widely regarded as part of customary international law.
Therefore, treaty non-membership does not necessarily mean that a state can disregard customary international-law obligations.
The immediate priority should be ending conflict and restoring stability rather than fundamentally altering the pre-existing arrangements governing the Strait.

UNCLOS वार्ताओं में सबसे कठिन मुद्दों में से एक Part XI के अंतर्गत गहरे समुद्र-तल से संबंधित व्यवस्था थी।
UNCLOS के अनुसार राष्ट्रीय अधिकार-क्षेत्र से बाहर स्थित गहरे समुद्र-तल और उसके संसाधन मानवजाति की साझा विरासत हैं।

इन संसाधनों पर किसी एक देश की संप्रभुता नहीं है।

रीगन प्रशासन ने Part XI की मूल व्यवस्था के कुछ प्रावधानों का विरोध किया क्योंकि उन्हें:

UNCLOS अंतरराष्ट्रीय नौवहन के लिए उपयोग किए जाने वाले जलडमरूमध्य में Transit Passage की व्यवस्था प्रदान करता है।
इसका उद्देश्य:
तटीय राज्य के हित ↔ अंतरराष्ट्रीय नौवहन की स्वतंत्रता

ईरान UNCLOS का पक्षकार नहीं है।
फिर भी Transit Passage का सिद्धांत प्रथागत अंतरराष्ट्रीय कानून (Customary International Law) का हिस्सा माना जाता है।
इसलिए किसी देश का संधि का पक्षकार न होना हमेशा उसे प्रथागत अंतरराष्ट्रीय कानून के नियमों से मुक्त नहीं करता।
तत्काल प्राथमिकता संघर्ष को समाप्त करना होनी चाहिए।
युद्ध से पहले होर्मुज जलडमरूमध्य में ऐसी गंभीर समस्या नहीं थी।
मौजूदा व्यवस्था को स्थिर करना अधिक महत्वपूर्ण है।
मलक्का–सिंगापुर जलडमरूमध्य विश्व के सबसे महत्वपूर्ण अंतरराष्ट्रीय समुद्री मार्गों में से एक है।
