Why in News?

The Kerala (Alteration of Name) Bill, 2026 seeks to change the official name of the State from “Kerala” to “Keralam”.

The Union Cabinet approved the proposal on 24 February 2026, following a unanimous resolution of the Kerala Legislative Assembly. The Bill was subsequently passed by Parliament in August 2026. The proposal is rooted primarily in Malayalam linguistic identity and the historical-cultural identity of the State.

Background: Why Kerala → Keralam?

The demand is essentially about aligning the constitutional/official name with the name used in the Malayalam language.

  • In Malayalam, the State is called “Keralam” (കേരളം).

  • Kerala was created on 1 November 1956 largely on linguistic lines as part of the reorganisation of States.

  • The Kerala Legislative Assembly argued that if the State was reorganised to represent the Malayalam-speaking population, its constitutional name should also reflect its Malayalam linguistic identity.

  • The Assembly passed a resolution on 24 June 2024 requesting the Union Government to change the name from Kerala to Keralam.

Constitutional Basis — Article 3:

Under Article 3, Parliament may by law:

  • Form a new State;

  • Increase the area of any State;

  • Diminish the area of any State;

  • Alter the boundaries of any State;

  • Alter the name of any State.

Therefore:

Changing the name of Kerala is an Article 3 matter, not an Article 368 constitutional amendment.

Procedure for Changing the Name of a State:

The constitutional process is important for examination purposes.

  • President’s recommendation: A Bill for alteration of the name of a State cannot be introduced in either House of Parliament without the recommendation of the President.

  • Reference to State Legislature: Where the Bill affects the area, boundaries or name of a State, the President refers it to the concerned State Legislature for expressing its views.

  • State Legislature gives its views: The State Legislature may support, oppose or suggest changes. But its consent is NOT mandatory.

    • Important distinction: State Legislature’s views = mandatory to be sought; State Legislature’s consent = NOT mandatory.

  • Parliament considers the Bill: After the prescribed consultation, the Bill can be introduced in Parliament.

  • Passage by Parliament: A law under Article 3 is passed by ordinary/simple majority, because such a law is not deemed to be a constitutional amendment under Article 368 by virtue of Article 4.

  • Presidential assent: After being passed by both Houses, the Bill is presented to the President for assent.

Article 4 —

Article 4 provides that laws made under Articles 2 and 3 may make consequential amendments to:

  • the First Schedule, and

  • the Fourth Schedule.

Such a law:

  • shall not be deemed to be an amendment of the Constitution for the purposes of Article 368.

Therefore, remember:

  • Article 3 → substantive power to alter State name/boundaries

  • Article 4 → consequential changes + no Article 368 procedure

Which Schedules are Relevant?

  • First Schedule — Directly important: The First Schedule contains the names of States and Union Territories and the territories of States and Union Territories. Therefore, changing Kerala → Keralam requires the corresponding change in the First Schedule.

  • Fourth Schedule — Consequential relevance: The Fourth Schedule deals with the allocation of seats in the Rajya Sabha to States and Union Territories. A State’s name appearing there may require a consequential textual change, but the renaming itself does not alter Kerala’s Rajya Sabha seat allocation.

Does the State Have a Veto?

No.

This is one of the most important conceptual points.

Suppose Parliament wants to alter the name of a State and the State Legislature disagrees. The State Legislature’s views must be obtained, but Parliament is not constitutionally bound to accept them.

  • State Legislature $\rightarrow$ Consultation, not veto.

Kerala and the Idea of Linguistic States:

The issue can be linked to the broader evolution of India’s federal structure.

  • Before Independence: The demand for States based on linguistic and cultural identities existed during the national movement.

  • After Independence: The Government initially adopted a cautious approach towards linguistic reorganisation because of concerns regarding national unity, administrative stability, regionalism, and security.

  • States Reorganisation Commission, 1953–55: The States Reorganisation Commission (SRC) examined the question of reorganising States, leading to the States Reorganisation Act, 1956, from which Kerala emerged as a major Malayalam-speaking State.

Is this a Constitutional Amendment under Article 368?

No.

This is a classic potential trap.

Although the First Schedule of the Constitution is affected, the change does not require an Article 368 constitutional amendment because Article 4 specifically provides that such a law shall not be deemed to be an amendment of the Constitution for the purposes of Article 368.
