What is Collegium System? कॉलेजियम प्रणाली

Why in news?

The Supreme Court Collegium recommended the transfer of Justice Manash Ranjan Pathak to the Gujarat High Court and Justice Krushna Ram Mohapatra to the Chhattisgarh High Court from the Orissa High Court.

Overview of the Collegium System:

The Collegium system is the mechanism in India for the appointment and transfer of judges to the Supreme Court and High Courts. Developed through landmark judicial pronouncements rather than statutory legislation, it ensures judicial independence by keeping the appointment process free from executive control.

Constitutional Framework for Judicial Appointments:

Supreme Court Judges (Article 124(2))

  • Appointed by the President of India.

  • Requires consultation with Supreme Court and High Court judges as deemed necessary.

High Court Judges (Article 217(1))

  • Appointed by the President of India.

  • Requires consultation with:

    • The Governor of the respective State.

    • The Chief Justice of India.

    • The Chief Justice of the concerned High Court.

Historical Evolution of Judicial Appointments:

  • Pre-1990s Era: Dominated by the Executive; notably exemplified by the 1973 supersession of three senior judges to appoint Justice A.N. Ray as Chief Justice of India.

  • First Judges Case (1981): Ruled that “consultation” with the CJI did not mean “concurrence,” preserving ultimate appointment power with the Executive.

  • Second Judges Case (1993): Established the Collegium system, ruling that “consultation” means “concurrence” of the CJI, shifting appointment primacy to the Judiciary.

  • Third Judges Case (1998): Expanded the Supreme Court Collegium to a body consisting of the CJI and the four senior-most judges.

The NJAC and the Fourth Judges Case:

  • National Judicial Appointments Commission (NJAC): Introduced via the 99th Constitutional Amendment Act, 2014, to replace the Collegium with a six-member body combining judicial and executive members.

  • Fourth Judges Case (2015): The Supreme Court struck down the NJAC as unconstitutional, ruling that it violated the basic structure doctrine by compromising judicial independence. The Collegium system was consequently restored.

Current Composition of Collegiums:

Supreme Court Collegium (1 + 4 Members)

  • Headed by the Chief Justice of India.

  • Comprises the four senior-most judges of the Supreme Court.

High Court Collegium (1 + 2 Members)

  • Headed by the Chief Justice of the respective High Court.

  • Comprises the two senior-most judges of that High Court.

Criticisms of the Collegium System:

  • Lack of Transparency: Deliberations and selection criteria lack public disclosure.

  • Absence of Statutory Backing: It is entirely a judicial creation without explicit parliamentary legislation.

  • Limited Diversity: Persistent underrepresentation of women, minority communities, and marginalized backgrounds.

Recommendations and Reform Committees/Commissions:

To address structural deficiencies, several official commissions and committees have historically recommended comprehensive reforms to the judicial appointment framework:

  • Law Commission of India (80th and 121st Reports): Recommended broad-based consultative bodies, increased transparency, and institutional checks to minimize executive dominance while curbing absolute judicial discretion.

  • National Commission to Review the Working of the Constitution (NCRWC, 2002): Headed by Justice M.N. Venkatachaliah, it recommended replacing the Collegium with a National Judicial Commission (NJC) consisting of the CJI, two senior-most judges, the Law Minister, and an eminent person appointed by the President in consultation with the CJI.

  • Venkkatachaliah Commission Proposals: Emphasized that the appointment process must incorporate institutionalized accountability, structured guidelines, and verifiable merit metrics to eliminate perceptions of arbitrariness and nepotism.

  • Way Forward:

    • Institutionalized Transparency: Establish formal, objective criteria and publish transparent guidelines for the selection, elevation, and transfer of judges to build public trust and minimize perceptions of arbitrariness.

    • Secretariat for the Collegium: Create a dedicated permanent secretariat to manage background checks, collate performance data, and maintain institutional memory, moving away from informal, opaque consultations.

    • Enhancing Diversity: Actively broaden representation by prioritizing qualified candidates from diverse regional, social, and gender backgrounds to ensure inclusivity across constitutional courts.

    • Balanced Accountability: Foster a harmonious institutional dialogue between the Judiciary and the Executive to draft reformed consultative mechanisms that preserve judicial independence while addressing legitimate calls for accountability.

    Conclusion:

    The Collegium system remains a vital safeguard for judicial independence and the separation of powers in India’s democracy. However, its long-term institutional legitimacy depends on its willingness to embrace internal structural reforms.   • कॉलेजियम के लिए सचिवालय: पृष्ठभूमि की जांच प्रबंधित करने, प्रदर्शन डेटा संकलित करने और संस्थागत स्मृति बनाए रखने के लिए एक समर्पित स्थायी सचिवालय का गठन किया जाए, जिससे अनौपचारिक और अस्पष्ट परामर्शों से दूर रहा जा सके।

  • विविधता बढ़ाना: संवैधानिक अदालतों में समावेशिता सुनिश्चित करने के लिए विविध क्षेत्रीय, सामाजिक और लैंगिक पृष्ठभूमि के योग्य उम्मीदवारों को प्राथमिकता देकर प्रतिनिधित्व को सक्रिय रूप से व्यापक बनाया जाए।

  • संतुलित जवाबदेही: जवाबदेही की वैध मांगों को संबोधित करते हुए न्यायिक स्वतंत्रता को सुरक्षित रखने वाले सुधारात्मक परामर्श तंत्र का मसौदा तैयार करने के लिए न्यायपालिका और कार्यपालिका के बीच एक सौहार्दपूर्ण संस्थागत संवाद को बढ़ावा दिया जाए।
