Daily legal Current : 8 Oct 2026/Karnataka HC: Facebook Post Using “Jihadi” Term/Sections 295A and 505(2) IPC

Why in News?
The Karnataka High Court (Justice V. Srishananda) on 21 September 2026 quashed criminal proceedings in Crime No. 40/2024 arising from a Facebook post containing the term “jihadi”, holding that the essential ingredients of the alleged offences under Sections 295A and 505(2) IPC were not made out. Continuation of proceedings would amount to abuse of the process of law.

Case Title & Facts:

  • Case: Atul Kumar Sabarwal @ Madhugiri Modi v. State of Karnataka
  • FIR: Registered by Badavanahalli Police Station (Madhugiri Taluk, Tumkur) on the complaint of a member of the police social-media monitoring cell.
  • Facebook Account: “Hindu Samrat Dharmasene”.
  • Impugned Post (approximate English translation):
“If the number of Jihadis increase, no law, no regulations, caste, money, and power will protect you. Be aware Hindus, your protection is in your hands. Whether you are a big police officer, or an IAS or IPS you have to retire one day. Be aware of the Jihadi’s sword that will slice your neck.”
  • Police alleged that use of the word “Jihadi” was intended to hurt the religious feelings of the Muslim community and could cause social disharmony.

Legal Provisions Involved:

  1. Section 295A IPC (Corresponding: Section 299 BNS):
  • Punishes deliberate and malicious acts intended to outrage the religious feelings of any class of citizens by insulting its religion or religious beliefs.
  • Essential Ingredients:
    • Insult (or attempt to insult) to religion or religious beliefs.
    • Done by words, signs, visible representations or otherwise.
    • With deliberate and malicious intention to outrage religious feelings of a class of citizens.
  • Key Judicial Principle: Mere use of an allegedly offensive word is not sufficient. The prosecution must establish mens rea of deliberate and malicious intention. The post must be examined as a whole, not by isolating a single word.
  1. Section 505(2) IPC (Corresponding: Section 353(2) BNS):
  • Deals with statements, rumours or reports published or circulated with intent to promote enmity, hatred or ill-will between different religious, racial, language, regional groups, castes or communities.
  • Requires intention to create or promote feelings of enmity, hatred or ill-will.

What was the Court’s View?

  • Mere use of the word “jihadi”, by itself, did not establish the ingredients of Section 295A IPC.
  • The Court examined the post as a whole rather than isolating a particular word.
  • The required mens rea / statutory ingredients of both Section 295A and Section 505(2) were not established.
  • The post was in the nature of a warning/advice to Hindus and did not disclose deliberate and malicious intention to outrage religious feelings or promote enmity.
  • Continuation of proceedings would amount to abuse of the process of law; hence the FIR and all further proceedings were quashed.

Constitutional Link:

  • Article 19(1)(a): Guarantees freedom of speech and expression.
  • Article 19(2): Permits reasonable restrictions on grounds including public order, but criminal law cannot be invoked merely because an expression is perceived as offensive by some.
  • Courts have consistently held that every offensive or objectionable expression relating to religion does not automatically attract Section 295A IPC / Section 299 BNS.

PCS-J / Judicial Service Key Points:

  • Deliberate and malicious intention is the sine qua non of Section 295A IPC.
  • The post must be read in its entirety; isolation of a single word is impermissible.
  • Where ingredients are clearly absent on the face of the material, High Courts can exercise inherent powers (Section 482 CrPC / corresponding BNSS provision) to quash proceedings at the threshold to prevent abuse of process.
  • Social-media posts require careful scrutiny of context, overall message and mens rea before registration of FIR under religious-offence provisions.
  • Parallel provisions under Bharatiya Nyaya Sanhita, 2023: Section 295A IPC → Section 299 BNS; Section 505(2) IPC → Section 353(2) BNS.

Core Legal Takeaway:
Every use of a potentially sensitive religious term does not ipso facto constitute an offence under Section 295A IPC or Section 505(2) IPC. The prosecution must prove deliberate and malicious intention to outrage religious feelings or promote enmity. In the absence of these essential ingredients, continuation of criminal proceedings amounts to abuse of the process of law and is liable to be quashed.

PCS-J/APO MAINS QN:

“Mere use of a potentially sensitive religious term in a social media post does not ipso facto attract the offence under Section 295A of the Indian Penal Code. Discuss

(PCS-J / APO Mains Question):
