Foreigners’ Right to Enter India:

Why in News?
The Delhi High Court held that possessing a valid visa does not give a foreign national an inherent or legally enforceable right to enter India.

Case:
A citizen of Turkmenistan, despite holding a valid business visa, was denied entry at Delhi Airport. Her husband, travelling with her, was allowed to enter.
The government cited adverse inputs, national security and public order concerns.

Court’s Ruling:
The Court held that:

  • A visa permits a foreigner to seek entry, but does not guarantee admission.
  • Visa issuance and immigration clearance are separate matters.
  • Entry of foreigners is subject to immigration laws and sovereign powers of the State.
  • National security, sovereignty, foreign relations and public health may be considered while deciding admission.
  • The husband’s admission did not by itself establish discrimination under Article 14, as the authorities had specific concerns regarding the petitioner.

Law: Immigration and Foreigners Act, 2025

Section 3:
A foreigner must possess a valid passport/travel document and visa to seek entry into India.
However, entry may be denied on grounds including:

  • National security
  • Sovereignty and integrity of India
  • Relations with foreign States
  • Public health
  • Other prescribed grounds

Section 7:
Empowers the Central Government to prohibit, regulate or restrict the entry, departure or stay of foreigners in India.

Constitutional Position:

  • Article 14: Equality before law applies, but persons who are not similarly situated may be treated differently.
  • Article 21: Foreigners enjoy protection of life and personal liberty.
  • Article 19(1)(e): Right to reside and settle in India is available only to citizens.

What Articles 21 & 19 Say:

  • Article 21 protects every person, not only Indian citizens. Therefore, a foreigner in India is entitled to protection of life and personal liberty and cannot be deprived of them except according to procedure established by law.
  • But Article 19 grants its listed freedoms only to Indian citizens.
  • Specifically, Article 19(1)(e) gives citizens the right “to reside and settle in any part of the territory of India.”
  • Therefore, a foreigner cannot claim a fundamental right to enter, reside or settle in India under Article 19(1)(e).
  • The government can therefore regulate entry, stay or departure of foreigners, subject to applicable law and constitutional protections such as Article 21.

Supreme Court Precedents:

  • Hans Muller of Nurenburg v. Superintendent, Presidency Jail (1955): Recognised the broad powers of the government regarding foreigners, including expulsion.
  • Louis De Raedt v. Union of India (1991): Held that foreigners are protected under Article 21, but do not have the Article 19(1)(e) right to reside and settle in India.

Significance:
The judgment establishes that possession of a visa is not an absolute right of admission. Immigration clearance remains subject to law, national security and sovereign discretion.

Mains Question:

“A valid visa does not create an absolute right of entry into India for a foreign national.” Discuss in the light of constitutional provisions and the Immigration and Foreigners Act, 2025.

विदेशियों का भारत में प्रवेश का अधिकार:

समाचार में क्यों?
दिल्ली उच्च न्यायालय ने यह निर्णय दिया कि वैध वीजा होना किसी विदेशी नागरिक को भारत में प्रवेश का अंतर्निहित या कानूनी रूप से प्रवर्तनीय अधिकार प्रदान नहीं करता।

मामला:
तुर्कमेनिस्तान की एक नागरिक के पास वैध बिजनेस वीजा होने के बावजूद दिल्ली हवाई अड्डे पर प्रवेश से इनकार कर दिया गया। उसके साथ यात्रा कर रहे पति को प्रवेश की अनुमति दे दी गई।
सरकार ने प्रतिकूल सूचनाओं, राष्ट्रीय सुरक्षा और लोक व्यवस्था संबंधी चिंताओं का हवाला दिया।

न्यायालय का निर्णय:
न्यायालय ने यह अभिनिर्धारित किया कि:

  • वीजा किसी विदेशी को प्रवेश मांगने की अनुमति देता है, किंतु प्रवेश की गारंटी नहीं देता।
  • वीजा जारी करना और आव्रजन निकासी अलग-अलग मामले हैं।
  • विदेशियों का प्रवेश आव्रजन कानूनों और राज्य की संप्रभु शक्तियों के अधीन है।
  • प्रवेश का निर्णय लेते समय राष्ट्रीय सुरक्षा, संप्रभुता, विदेशी संबंध और जन स्वास्थ्य को ध्यान में रखा जा सकता है।
  • पति को प्रवेश मिलने मात्र से अनुच्छेद 14 के अंतर्गत भेदभाव सिद्ध नहीं होता, क्योंकि याचिकाकर्ता के संबंध में प्राधिकारियों के पास विशिष्ट चिंताएँ थीं।

कानून: आव्रजन और विदेशी अधिनियम, 2025

धारा 3:
किसी विदेशी को भारत में प्रवेश मांगने के लिए वैध पासपोर्ट/यात्रा दस्तावेज और वीजा होना आवश्यक है।
तथापि, निम्नलिखित आधारों पर प्रवेश से इनकार किया जा सकता है:

  • राष्ट्रीय सुरक्षा
  • भारत की संप्रभुता और अखंडता
  • विदेशी राज्यों के साथ संबंध
  • जन स्वास्थ्य
  • अन्य निर्धारित आधार

धारा 7:
केंद्र सरकार को विदेशियों के प्रवेश, प्रस्थान या भारत में रहने पर प्रतिबंध लगाने, विनियमित करने या निर्बंधित करने की शक्ति प्रदान करती है।

संवैधानिक स्थिति:

  • अनुच्छेद 14: कानून के समक्ष समानता लागू होती है, किंतु जो व्यक्ति समान स्थिति में नहीं हैं, उनके साथ भिन्न व्यवहार किया जा सकता है।
  • अनुच्छेद 21: विदेशी भी जीवन और व्यक्तिगत स्वतंत्रता की सुरक्षा का अधिकार रखते हैं।
  • अनुच्छेद 19(1)(ङ): भारत में निवास करने और बसने का अधिकार केवल नागरिकों को उपलब्ध है।

अनुच्छेद 21 और 19 क्या कहते हैं?

  • अनुच्छेद 21 प्रत्येक व्यक्ति की सुरक्षा करता है, केवल भारतीय नागरिकों की नहीं। इसलिए भारत में स्थित कोई विदेशी जीवन और व्यक्तिगत स्वतंत्रता की सुरक्षा का हकदार है और उसे कानून द्वारा स्थापित प्रक्रिया के अनुसार ही इनसे वंचित किया जा सकता है।
  • किंतु अनुच्छेद 19 अपनी सूचीबद्ध स्वतंत्रताएँ केवल भारतीय नागरिकों को प्रदान करता है।
  • विशेष रूप से, अनुच्छेद 19(1)(ङ) नागरिकों को “भारत के राज्यक्षेत्र के किसी भाग में निवास करने और बसने” का अधिकार देता है।
  • इसलिए कोई विदेशी अनुच्छेद 19(1)(ङ) के अंतर्गत भारत में प्रवेश करने, निवास करने या बसने का मौलिक अधिकार दावा नहीं कर सकता।
  • अत: सरकार विदेशियों के प्रवेश, ठहराव या प्रस्थान को लागू कानून और अनुच्छेद 21 जैसी संवैधानिक सुरक्षाओं के अधीन विनियमित कर सकती है।

 उच्चतम न्यायालय के पूर्व निर्णय:

  • हैंस मुलर ऑफ नुरेनबर्ग बनाम सुपरिंटेंडेंट, प्रेसिडेंसी जेल (1955): विदेशियों के संबंध में सरकार की व्यापक शक्तियों, जिसमें निष्कासन भी शामिल है, को मान्यता दी गई।
  • लुईस डी रेड्ट बनाम भारत संघ (1991): यह अभिनिर्धारित किया गया कि विदेशी अनुच्छेद 21 के अंतर्गत संरक्षित हैं, किंतु उन्हें अनुच्छेद 19(1)(ङ) के अंतर्गत भारत में निवास करने और बसने का अधिकार नहीं है।
