Why in News?

The Kerala High Court’s Rules Committee has decided to remove the provision requiring traditional “tom-tom” and “kinnam mutti vilambaram” for publicising property attachment proceedings.

The move seeks to replace an archaic method of public notification with modern means of communication such as notices, newspapers and digital platforms.

What is “Tom-Tom”?

  • Tom-tom refers to the practice of making public announcements through drum beating in public places.

  • Kinnam mutti vilambaram refers to making announcements by beating a metal plate.

  • The objective was to ensure that a court or government announcement reached the maximum number of people in the locality.

Historical Background:

  • The practice dates back to the period of princely rule in Kerala.

  • Royal officials would gather people in markets and other public places, use drumbeats to attract attention and then read out the ruler’s order.

  • During the British period, a similar method was adopted for making property attachment proceedings publicly known.

  • The practice subsequently continued within the formal judicial procedure.

Legal Basis:

  • The practice continued under Sub-rule (2) of Rule 54 of Order XXI of the Code of Civil Procedure, 1908 (CPC).

  • Order XXI deals with matters relating to the execution of decrees and orders.

  • Rule 54 relates to attachment of immovable property in execution proceedings.

  • Public announcement was intended to provide notice to the public and interested parties regarding the attachment.

Decline of the Practice:

  • Drum-beating had already largely disappeared from several district courts, including those in Palakkad, Thiruvananthapuram, Ernakulam and Kozhikode.

  • However, the practice of beating a metal plate continued in some areas.

  • Such announcements were also recorded in court records.

Tom-Tom Charges:

  • The practice involved a specific public-announcement charge.

  • RTI information showed that courts in Palakkad collected ₹56,600 as “tom-tom charges” between January and October 2022.

  • The charge was increased from ₹15 to ₹100 in 2016.

  • The continuation of a separate charge for such an outdated method raised questions about the relevance of the practice.

केरल उच्च न्यायालय की नियम समिति ने संपत्ति की कुर्की संबंधी कार्यवाही को सार्वजनिक करने के लिए प्रचलित पारंपरिक “टॉम-टॉम” तथा “किन्नम मुट्टी विलंबरम” की व्यवस्था को समाप्त करने का निर्णय लिया है। यह निर्णय न्यायिक प्रक्रियाओं में आधुनिक सूचना एवं संचार प्रौद्योगिकी के बढ़ते उपयोग को दर्शाता है।

“टॉम-टॉम” क्या है?

  • टॉम-टॉम का अर्थ ढोल बजाकर सार्वजनिक रूप से किसी आदेश या सूचना की उद्घोषणा करना है।

  • “किन्नम मुट्टी विलंबरम” में धातु की प्लेट बजाकर लोगों का ध्यान आकर्षित करके सूचना दी जाती थी।

  • बाद में ब्रिटिश शासन ने संपत्ति की कुर्की संबंधी कार्यवाहियों को सार्वजनिक करने के लिए इसी प्रकार की व्यवस्था अपनाई।

  • स्वतंत्रता के बाद भी यह प्रक्रिया न्यायिक व्यवस्था में विभिन्न रूपों में जारी रही।

विधिक आधार:

  • यह प्रथा सिविल प्रक्रिया संहिता, 1908 (CPC) के अंतर्गत जारी रही।

  • कुछ स्थानों पर अभी भी धातु की प्लेट बजाकर सूचना देने की परंपरा जारी थी।

  • ऐसी उद्घोषणाओं का उल्लेख न्यायालयीन अभिलेखों में भी किया जाता था।

“टॉम-टॉम शुल्क”:

  • सार्वजनिक उद्घोषणा के लिए निर्धारित शुल्क भी लिया जाता था।

  • सूचना के अधिकार अधिनियम के तहत प्राप्त जानकारी के अनुसार, जनवरी से अक्टूबर 2022 के बीच पालक्काड के जिला न्यायालय, उप-न्यायालय और मुंसिफ न्यायालय में ₹56,600 “टॉम-टॉम शुल्क” के रूप में एकत्र किए गए।

  • वर्ष 2016 में यह शुल्क ₹15 से बढ़ाकर ₹100 किया गया था।

  • इससे पारंपरिक स्थानीय उद्घोषणा पर निर्भरता कम होती है।

  • डिजिटल रिकॉर्ड सूचना के प्रलेखन, संरक्षण और सत्यापन को आसान बनाते हैं।

  • सूचना के प्रसार में समय और प्रशासनिक संसाधनों की बचत हो सकती है।

न्याय तक पहुँच:

  • प्रौद्योगिकी न्यायिक सूचना को भौगोलिक सीमाओं से परे उपलब्ध कराने में सहायक है।

  • नागरिकों को न्यायालयीन कार्यवाही से संबंधित जानकारी अधिक शीघ्र प्राप्त हो सकती है।

डिजिटल विभाजन की चुनौती:

  • डिजिटल माध्यमों के बढ़ते उपयोग के बावजूद ग्रामीण, गरीब तथा डिजिटल सुविधाओं से वंचित लोगों की आवश्यकताओं को ध्यान में रखना आवश्यक है।

  • अतः डिजिटल व्यवस्था के साथ उपयुक्त वैकल्पिक ऑफलाइन सूचना माध्यम भी उपलब्ध रहने चाहिए।

न्यायिक आधुनिकीकरण:
पुरानी एवं अप्रासंगिक प्रक्रियाओं को आधुनिक तकनीकी साधनों से प्रतिस्थापित करना।

प्रक्रियात्मक दक्षता:
अनावश्यक प्रशासनिक प्रक्रियाओं और संबंधित व्यय को कम करना।

पारदर्शिता:
सूचना के व्यवस्थित डिजिटल अभिलेखीकरण एवं प्रसार को बढ़ावा देना।

सुलभ न्याय:
न्यायिक सूचनाओं को अधिक व्यापक और शीघ्रता से उपलब्ध कराना।

तकनीक और न्याय का समन्वय:
परंपरागत न्यायिक प्रक्रियाओं को ई-गवर्नेंस एवं डिजिटल न्याय प्रणाली के अनुरूप विकसित करना।

 निष्कर्ष:

“टॉम-टॉम” जैसी पारंपरिक उद्घोषणा प्रणाली की समाप्ति न्यायिक व्यवस्था में प्रौद्योगिकी आधारित आधुनिकीकरण की दिशा में एक कदम है। हालांकि, न्यायिक डिजिटलीकरण का उद्देश्य केवल पुरानी प्रक्रियाओं को समाप्त करना नहीं होना चाहिए, बल्कि पारदर्शिता, सूचना तक समान पहुँच, प्रक्रियात्मक दक्षता और प्राकृतिक न्याय को सुदृढ़ करना होना चाहिए। इसलिए तकनीकी नवाचार और समावेशी न्यायिक पहुँच के बीच संतुलन आवश्यक है।
