Main Question Asked by Court:
If someone takes a photo of a celebrity and uses it —
does it violate the celebrity’s personality rights?
Even when the copyright of that photo belongs to the photographer?
What Court Said?
- Copyright always goes to the person who clicks the photo.
- Just like a photo of Taj Mahal belongs to the photographer,
a photo of a celebrity also belongs to the photographer.
- So the big question is:
Can the photographer freely use that photo,
or does he still need the celebrity’s permission?
What Lawyer for Aaradhya Bachchan Said?
- Yes, using the photo violates personality rights.
- Exception: Only if the photo was taken with the celebrity’s permission.
- Even if you own the copyright,
you still need clearance of personality rights to use the photo.

4. Titan Industries Ltd. v. Ramkumar Jewellers (2012) – Delhi HC
- Case of Amitabh Bachchan & Jaya Bachchan photographs used without permission.
- Court said:
“The right to control the commercial use of human identity is the right to publicity.”
- Celebrity’s image cannot be used for advertisement without consent.
5. Shivaji Rao Gaikwad (Rajinikanth) v. Varsha Productions (2015) – Madras HC
- Protected Rajinikanth’s name, image and style.
- Court held that once a person becomes a celebrity,
unauthorised use of his persona is illegal.
6. Amitabh Bachchan v. Rajat Nagi (2022) – Delhi HC
- First major John Doe (Ashok Kumar) order for personality rights.
- Protected name, image, voice and persona against unknown defendants.
- Very wide injunction granted.
7. Anil Kapoor v. Simply Life India (2023) – Delhi HC
- Strong modern case.
- Protected name, image, voice, likeness, gestures and catchphrase “Jhakaas”.
- Also covered AI-generated deepfakes and online misuse.
- One of the most cited recent judgments.
8. Jackie Shroff case (2024) – Delhi HC
- Protected name, image, voice and nickname “Bhidu”.
- Court said unauthorised commercial use dilutes the celebrity’s brand value.

न्यायालय द्वारा उठाया गया मुख्य प्रश्न
यदि कोई व्यक्ति किसी सेलिब्रिटी की फोटो खींचकर उसका उपयोग करता है —
क्या इससे सेलिब्रिटी के व्यक्तित्व अधिकारों (Personality Rights) का उल्लंघन होता है?
यहाँ तक कि जब उस फोटो का कॉपीराइट फोटोग्राफर के पास हो?
न्यायालय ने क्या कहा?
- कॉपीराइट हमेशा उस व्यक्ति को मिलता है जो फोटो खींचता है।
- जैसे ताजमहल की फोटो फोटोग्राफर की होती है,
वैसे ही सेलिब्रिटी की फोटो भी फोटोग्राफर की होती है।
- मुख्य प्रश्न यह है:
क्या फोटोग्राफर उस फोटो का स्वतंत्र रूप से उपयोग कर सकता है,
या उसे सेलिब्रिटी की अनुमति लेनी होगी?
आराध्या बच्चन की ओर से अधिवक्ता का तर्क:
- हाँ, फोटो का उपयोग व्यक्तित्व अधिकारों का उल्लंघन करता है।
- अपवाद: केवल तभी जब फोटो सेलिब्रिटी की अनुमति से खींची गई हो।
- भले ही फोटोग्राफर के पास कॉपीराइट हो,
फिर भी फोटो का व्यावसायिक उपयोग करने के लिए व्यक्तित्व अधिकारों की अनुमति आवश्यक है।

याद रखने योग्य मुख्य बिंदु:
कॉपीराइट = फोटोग्राफर का अधिकार

भले ही फोटोग्राफर के पास कॉपीराइट हो,
फिर भी फोटो का व्यावसायिक उपयोग करने के लिए सेलिब्रिटी की अनुमति आवश्यक हो सकती है।

1. आर. राजगोपाल बनाम तमिलनाडु राज्य (1994) – सर्वोच्च न्यायालय:
- इसे ऑटो शंकर मामला भी कहा जाता है।
- सर्वोच्च न्यायालय ने पहली बार अनुच्छेद 21 के अंतर्गत निजता के अधिकार को मान्यता दी।
- व्यक्ति को अपने निजी जीवन के प्रकाशन पर नियंत्रण का अधिकार है।

2. आईसीसी डेवलपमेंट (इंटरनेशनल) लिमिटेड बनाम अर्वी एंटरप्राइजेज (2003) – दिल्ली उच्च न्यायालय;
- न्यायालय ने स्पष्ट रूप से कहा:
प्रचार का अधिकार (Right of Publicity) केवल व्यक्ति (सेलिब्रिटी) में निहित है,
किसी कार्यक्रम या कंपनी में नहीं।
- व्यावसायिक प्रचार अधिकार की पहली स्पष्ट मान्यता।
3. डी.एम. एंटरटेनमेंट प्राइवेट लिमिटेड बनाम बेबी गिफ्ट हाउस (2010) – दिल्ली उच्च न्यायालय
- गायक डेलर मेहंदी से संबंधित मामला।
- न्यायालय ने कहा कि सेलिब्रिटी के नाम, छवि या व्यक्तित्व का बिना अनुमति व्यावसायिक उपयोग अवैध है।
- व्यक्तित्व अधिकार + पासिंग ऑफ दोनों लागू हो सकते हैं।
4. टाइटन इंडस्ट्रीज लिमिटेड बनाम रामकुमार ज्वैलर्स (2012) – दिल्ली उच्च न्यायालय
- अमिताभ बच्चन और जया बच्चन की फोटो बिना अनुमति उपयोग किए जाने का मामला।
- न्यायालय ने कहा:
“मानव पहचान के व्यावसायिक उपयोग को नियंत्रित करने का अधिकार ही प्रचार का अधिकार है।”
- सेलिब्रिटी की छवि का विज्ञापन में बिना सहमति उपयोग नहीं किया जा सकता।
5. शिवाजी राव गायकवाड़ (रजनीकांत) बनाम वर्षा प्रोडक्शंस (2015) – मद्रास उच्च न्यायालय:
- रजनीकांत के नाम, छवि और अंदाज की रक्षा की गई।
- न्यायालय ने कहा कि एक बार व्यक्ति सेलिब्रिटी बन जाए,
तो उसके व्यक्तित्व का बिना अनुमति उपयोग अवैध है।
6. अमिताभ बच्चन बनाम रजत नागी (2022) – दिल्ली उच्च न्यायालय:
- व्यक्तित्व अधिकारों के लिए पहला बड़ा जॉन डो (अशोक कुमार) आदेश।
- नाम, छवि, आवाज और व्यक्तित्व को अज्ञात प्रतिवादियों के विरुद्ध सुरक्षित किया गया।
- अत्यंत व्यापक निषेधाज्ञा जारी की गई।
7. अनिल कपूर बनाम सिंपली लाइफ इंडिया (2023) – दिल्ली उच्च न्यायालय;
- आधुनिक महत्वपूर्ण निर्णय।
