Mob Lynching in India: Moolathara Case, Kerala
Why in News?
The alleged mob lynching of an unidentified, homeless, hearing-impaired and non-speaking man near the Moolathara dam in Palakkad district, Kerala, has raised concerns about mob violence, the rule of law and the protection of vulnerable persons. The victim reportedly suffered nearly 50 injuries.
Key Points:
- Incident: The man was allegedly beaten with sticks and stones after sleeping outside a house at Nedumpara.
- Investigation: Seven people were booked in connection with the killing, and a Special Investigation Team (SIT) was constituted.
- Similar Cases: The incident recalls the lynching of Madhu (2018) in Attappady and Ram Narayan Baghel (2025) at Walayar.
- Core Issue: Suspicion of wrongdoing cannot justify mob violence or extrajudicial punishment.
- Constitutional Principle: The Rule of Law requires guilt to be determined through a lawful judicial process, not by a mob.
Relevant Legal Provisions: BNS, BNSS and BSA
Bharatiya Nyaya Sanhita (BNS), 2023
- Section 103(2) – Mob Lynching: Provides punishment when five or more persons acting in concert commit murder on specified grounds, including race, caste or community, sex, place of birth, language or personal belief, or other grounds specified in the provision.
- Punishment: Death or imprisonment for life, along with a fine.
- Important Legal Point: Section 103(2) does not apply automatically to every group murder. The statutory conditions, including the specified grounds, must be established.
- Section 103(1) – Murder: Prescribes death or imprisonment for life, and fine for murder.
- Section 189 – Unlawful Assembly: Deals with membership of an unlawful assembly and related offences.
- Section 190 – Common Object: Provides for the liability of members of an unlawful assembly when an offence is committed in prosecution of its common object, subject to the statutory requirements.
- Section 191 – Rioting: Deals with the offence of rioting.
Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023
- Section 173 – Information in Cognizable Cases: Governs the recording of information relating to cognizable offences.
- Section 176 – Procedure for Investigation: Deals with the police investigation process, including investigation of the circumstances of an alleged offence and collection of evidence.
Bharatiya Sakshya Adhiniyam (BSA), 2023
- Section 23 – Confession to Police: A confession made to a police officer generally cannot be proved against an accused person.
- Discovery Exception: The portion of information that distinctly relates to a fact discovered as a consequence of information received from an accused may be proved, subject to the statutory conditions.
- Relevance to the Case: The report mentions an accused person’s confession as an investigative lead. Its admissibility depends on the rules of evidence, not merely on its being described as a confession.
Important Supreme Court Judgment
Tehseen S. Poonawalla v. Union of India (2018):
- Court: Supreme Court of India.
- Issue: Prevention and punishment of mob lynching and mob violence.
- Judgment: The Supreme Court laid down preventive, remedial and punitive measures to address lynching.
Key Directions:
- Nodal Police Officers: Appointment of designated officers to prevent mob violence in each district.
- Identification of Vulnerable Areas: Identification and monitoring of areas prone to lynching.
- Prompt Investigation: Timely registration and investigation of cases.
- Speedy Trials: Expeditious judicial proceedings against the accused.
- Victim Compensation: Appropriate compensation for victims or their families.
- Official Accountability: Action against public officials who fail to perform their legally prescribed duties.
Legal Significance: The judgment reinforces that no individual or mob has the authority to take the law into its own hands.
Constitutional Provisions:
- Article 14: Guarantees equality before the law and equal protection of the laws.
- Article 21: Protects life and personal liberty, including the right to live with human dignity.
- Article 39A: Directs the State to promote equal justice and free legal aid.
Conclusion:
The Moolathara incident highlights the need for effective criminal investigation, accountability, protection of vulnerable persons and enforcement of the rule of law. Suspicion cannot replace evidence, and a mob cannot replace a court of law.
Should the Age of Consent Be Lowered?
The Hindu | Current Affairs | Polity, Governance and Child Rights
Why in News?
The Supreme Court of India has raised concerns about the application of the Protection of Children from Sexual Offences (POCSO) Act, 2012 in cases involving consensual romantic relationships between adolescents. The debate centres on whether genuine relationships between teenagers close in age should be treated differently from cases involving sexual abuse, coercion and exploitation.
What Is the Age of Consent?
- Age of Consent: The legally recognised age at which a person can consent to sexual activity.
- In India, the age of consent is 18 years.
- Under Section 2(1)(d) of the POCSO Act, 2012, a child means any person below 18 years of age.
- Sexual activity involving a person below 18 may attract criminal liability even if the adolescent claims that the relationship was consensual.
- The law aims to protect children from sexual abuse, exploitation, coercion and trafficking.
Why Has the Debate Arisen?
- Consensual Adolescent Relationships: Some cases involve teenagers aged 16–18 years who claim to be in voluntary romantic relationships.
- Parental Opposition: In certain cases, parents opposing a relationship or marriage may initiate criminal proceedings against the adolescent’s partner.
- Criminalisation of Adolescents: The strict age threshold may lead to criminal proceedings even in cases where the relationship appears voluntary.
- Judicial Concerns: Courts have highlighted the need to distinguish genuine adolescent relationships from cases involving coercion, manipulation or sexual exploitation.
Arguments in Favour of Reform:
- Adolescent Autonomy: The evolving maturity and decision-making capacity of older adolescents should be considered.
- Prevention of Misuse: Reform may reduce the use of POCSO in cases arising primarily from family opposition to relationships.
- Proportionate Justice: Genuine peer relationships may require a different legal response from cases involving force, grooming or exploitation.
- Reduced Social Harm: Avoiding unnecessary criminal prosecution may prevent long-term psychological and social consequences for adolescents.
Arguments Against Lowering the Age of Consent
- Risk of Exploitation: A lower age threshold could make it easier for adults to disguise abuse as a consensual relationship.
- Unequal Power Relations: Adolescents may be vulnerable to emotional pressure, manipulation, grooming and coercion.
- Child Protection: The existing age threshold provides a clear and uniform legal safeguard.
- Risk to Vulnerable Children: Any relaxation must not weaken protection against sexual abuse, trafficking and exploitation, particularly for vulnerable girls and children.
What Is a Romeo–Juliet Clause?
A Romeo–Juliet clause is a proposed legal exception intended to protect genuine, consensual relationships between adolescents who are close in age from being treated in the same way as cases of sexual exploitation.
- Close-in-Age Relationships: It focuses on relationships between adolescents whose ages are relatively close.
- Age Difference: The law may specify a maximum permissible age gap.
- Safeguards: The exception must not apply to cases involving force, coercion, grooming, manipulation or abuse of authority.
- Current Status: A Romeo–Juliet clause is a proposal for legal reform and is not a general exception currently provided under the POCSO Act.
What Did the Law Commission Recommend?
The 22nd Law Commission of India, in its 283rd Report (2023) on the age of consent under POCSO, made important observations:
- It did not recommend reducing the age of consent from 18 to 16 years.
- It recognised that some cases involving adolescents aged 16–18 years may differ from cases involving exploitation or coercion.
- It suggested that guided judicial discretion in sentencing could be considered in appropriate cases rather than reducing the age of consent for everyone.
Important Judicial Developments
- State of Uttar Pradesh v. Anurudh & Anr. (2026): The Supreme Court raised concerns regarding genuine adolescent relationships under the POCSO framework and urged consideration of appropriate corrective measures.
- Vijayalakshmi v. State (2021): The Madras High Court expressed concerns about the application of POCSO in cases involving consensual adolescent relationships.
- Legal Position: Judicial observations do not automatically change the law. Under the existing POCSO framework, a person below 18 years is a child, and a claim of consent does not by itself create an exception.
Way Forward:
- Retain Strong Child Protection: Maintain strict safeguards against sexual abuse, coercion, trafficking and exploitation.
- Consider a Narrow Exception: Examine a carefully defined close-in-age exception for genuine relationships between older adolescents.
- Prevent Adult Exploitation: Ensure that adults cannot use claims of consent to escape criminal liability for exploiting minors.
- Promote Awareness: Strengthen age-appropriate education about consent, healthy relationships and legal rights.
- Improve Judicial Scrutiny: Ensure that investigations and trials distinguish genuine adolescent relationships from exploitative conduct, wherever legally relevant.
- Provide Support Services: Strengthen counselling, legal aid and child-friendly assistance for adolescents.
Conclusion:
The debate is not merely about lowering the age of consent. It concerns balancing child protection, adolescent autonomy and the prevention of misuse of criminal law. Any reform should protect children from exploitation while ensuring that genuine relationships between adolescents are assessed fairly, without weakening the fundamental objectives of the POCSO Act.
- State of Uttar Pradesh v. Anurudh & Anr.
- Vijayalakshmi v.
