The Chhattisgarh High Court held that the State Women Commission cannot issue binding directions affecting the service conditions of a government employee.
A government school principal challenged proceedings of the Chhattisgarh State Women Commission.
The Commission had recommended his transfer to another Block following allegations made by an Assistant Teacher.
The principal argued that the Commission had acted without jurisdiction because the statute did not confer power to interfere in service matters.
Can the State Women Commission issue binding directions affecting an employee’s service conditions?
Held: No.
The Commission’s jurisdiction is recommendatory and facilitative, not adjudicatory.
Receive complaints relating to deprivation of women’s rights.
Examine grievances concerning women.
Take up matters with concerned authorities.
Recommend appropriate remedial measures.
In Bhabani Prasad Jena v. Convenor Secretary, Orissa State Commission for Women, the Supreme Court held that the Commission can receive complaints and take up grievances with appropriate authorities, but it cannot adjudicate or determine the rights of parties.
Article 14: Equality before law and equal protection of laws.
Article 15(1): Prohibits discrimination on grounds of sex, among other grounds.
Article 15(3): Permits the State to make special provisions for women and children.
Article 16: Guarantees equality of opportunity in public employment.
Article 21: Protects life and personal liberty, including dignity.
Article 39(a): Equal right of men and women to adequate means of livelihood.
Article 39(d): Equal pay for equal work for men and women.
Article 42: Directs the State to ensure just and humane conditions of work and maternity relief.
Article 51A(e): Fundamental duty to renounce practices derogatory to the dignity of women.
Women’s Commission → statutory body with recommendatory powers; it cannot assume adjudicatory or binding powers unless expressly conferred by law.
छत्तीसगढ़ उच्च न्यायालय ने कहा कि राज्य महिला आयोग किसी सरकारी कर्मचारी की सेवा शर्तों को प्रभावित करने वाला बाध्यकारी निर्देश जारी नहीं कर सकता।
एक सरकारी स्कूल के प्राचार्य ने राज्य महिला आयोग की कार्यवाही को चुनौती दी।
आयोग ने एक सहायक शिक्षिका की शिकायत के आधार पर प्राचार्य का दूसरे ब्लॉक में स्थानांतरण करने की सिफारिश की थी।
प्राचार्य ने तर्क दिया कि आयोग ने अपने अधिकार क्षेत्र से बाहर जाकर कार्य किया।
क्या राज्य महिला आयोग किसी कर्मचारी की सेवा शर्तों को प्रभावित करने वाला बाध्यकारी निर्देश दे सकता है?
निर्णय: नहीं।
आयोग का अधिकार क्षेत्र मुख्यतः सिफारिशात्मक और सुविधाकारी है, न्यायनिर्णयनात्मक नहीं।
महिलाओं के अधिकारों के वंचन से संबंधित शिकायतें प्राप्त करना।
महिलाओं की शिकायतों एवं समस्याओं की जांच करना।
मामलों को संबंधित प्राधिकरणों के समक्ष उठाना।
उचित उपचारात्मक उपायों की सिफारिश करना।
Bhabani Prasad Jena v. Convenor Secretary, Orissa State Commission for Women में सर्वोच्च न्यायालय ने कहा कि आयोग शिकायत प्राप्त कर सकता है और उचित कार्रवाई के लिए संबंधित प्राधिकरण के समक्ष मामला उठा सकता है, लेकिन उसे पक्षकारों के अधिकारों का न्यायनिर्णयन या निर्धारण करने की शक्ति नहीं है।
अनुच्छेद 14: कानून के समक्ष समानता और विधि का समान संरक्षण।
अनुच्छेद 15(1): लिंग के आधार पर भेदभाव का निषेध।
अनुच्छेद 15(3): राज्य को महिलाओं और बच्चों के लिए विशेष प्रावधान बनाने की अनुमति।
अनुच्छेद 16: लोक नियोजन में अवसर की समानता।
अनुच्छेद 21: जीवन और व्यक्तिगत स्वतंत्रता, जिसमें गरिमा का अधिकार भी शामिल है।
अनुच्छेद 39(a): पुरुषों और महिलाओं को आजीविका के पर्याप्त साधनों का समान अधिकार।
अनुच्छेद 39(d): पुरुषों और महिलाओं के लिए समान कार्य के लिए समान वेतन।
अनुच्छेद 42: न्यायसंगत एवं मानवीय कार्य दशाएँ तथा मातृत्व राहत।
अनुच्छेद 51A(e): महिलाओं की गरिमा के विरुद्ध प्रथाओं का त्याग करना नागरिकों का मौलिक कर्तव्य।
राज्य महिला आयोग → वैधानिक निकाय → सिफारिशात्मक शक्ति → न्यायनिर्णयन की शक्ति नहीं → वैधानिक अधिकार के बिना बाध्यकारी सेवा संबंधी निर्देश जारी नहीं कर सकता।
