The Supreme Court recently examined a challenge to the 2026 amendment to the Prevention of Insults to National Honour Act, 1971, concerning the National Song Vande Mataram.
The Court also considered government directions prescribing the singing of the full six-stanza version at specified official functions.
The Bench, headed by CJI Surya Kant, sought the Centre’s response and examined whether refusal to sing on genuine conscientious or religious grounds can attract criminal consequences.
The case primarily raises the question:
Whether a person can be subjected to criminal liability for refusing to sing the National Song on grounds of genuine freedom of conscience or religious belief.
It involves the interplay between:

The 2026 amendment extended statutory protection under the 1971 Act to the National Song.
Intentional prevention of singing of the National Anthem or National Song, or causing disturbance to an assembly engaged in such singing, may attract:
Imprisonment up to 3 years;
Fine; or
Both.
The Court indicated that genuine conscientious or religious objectors cannot simply be subjected to criminal punishment merely because they decline to sing.
The precise scope of such protection and the constitutional validity of the amended law remain to be determined.
These observations were made during the hearing and do not constitute a final judgment.
The Supreme Court protected school students who respectfully stood during the National Anthem but did not sing it because of their religious beliefs. The Court recognised:
Freedom of conscience;
Freedom of religion;
Protection against compelled expression; and
Constitutional tolerance of genuine beliefs.
Respect for the National Anthem or National Song does not automatically extinguish constitutionally protected freedom of conscience.
The State may prescribe rules concerning national symbols, but such regulation must remain consistent with fundamental rights and constitutional limitations.
The Supreme Court has not yet finally decided the constitutional challenge.
The Centre’s response has been sought.
The validity and scope of the 2026 amendment and the related government directions remain sub judice.

सुप्रीम कोर्ट ने हाल ही में राष्ट्रीय सम्मान अपमान निवारण अधिनियम, 1971 के 2026 के संशोधन को चुनौती देने वाली याचिका की परीक्षा की, जो राष्ट्रीय गीत ‘वंदे मातरम्’ से संबंधित है।
न्यायालय ने विशिष्ट राजकीय समारोहों में पूरे छह छंदों वाले संस्करण को गाने का निर्देश देने वाले सरकारी दिशा-निर्देशों पर भी विचार किया।
मुख्य न्यायाधीश (CJI) सूर्यकांत की अध्यक्षता वाली पीठ ने केंद्र सरकार से जवाब तलब किया और यह जांच की कि क्या वास्तविक अंतरात्मा या धार्मिक आधार पर गाना न गाने पर आपराधिक परिणाम हो सकते हैं।
इस मामले में मुख्य रूप से यह प्रश्न उठता है:
क्या किसी व्यक्ति को अंतरात्मा की सच्ची स्वतंत्रता या धार्मिक विश्वास के आधार पर राष्ट्रीय गीत गाने से मना करने पर आपराधिक दायित्व के अधीन किया जा सकता है।

2026 के संशोधन ने 1971 के अधिनियम के तहत सांविधिक सुरक्षा का विस्तार राष्ट्रीय गीत तक कर दिया है।
राष्ट्रीय गान या राष्ट्रीय गीत गाने में जानबूझकर बाधा डालना, या ऐसे गायन में संलग्न सभा में व्यवधान उत्पन्न करना, इसके अंतर्गत आ सकता है:
3 वर्ष तक का कारावास;
जुर्माना; या
दोनों।
न्यायालय ने संकेत दिया कि केवल इसलिए कि वे गाने से मना करते हैं, वास्तविक अंतरात्मा या धार्मिक मानने वाले व्यक्तियों को मात्र आपराधिक दंड के अधीन नहीं किया जा सकता है।
ऐसी सुरक्षा की सटीक गुंजाइश और संशोधित कानून की संवैधानिक वैधता अभी निर्धारित होनी बाकी है।
ये टिप्पणियाँ सुनवाई के दौरान की गई थीं और ये कोई अंतिम निर्णय नहीं हैं।
सुप्रीम कोर्ट ने उन स्कूली छात्रों की रक्षा की, जो अपने धार्मिक विश्वासों के कारण राष्ट्रीय गान के दौरान सम्मानपूर्वक खड़े रहे लेकिन उसे गाया नहीं। न्यायालय ने निम्नलिखित को मान्यता दी:
अंतरात्मा की स्वतंत्रता;
धर्म की स्वतंत्रता;
बाध्य अभिव्यक्ति के विरुद्ध संरक्षण; और
वास्तविक विश्वासों के प्रति संवैधानिक सहिष्णुता।
राष्ट्रीय गान या राष्ट्रीय गीत के प्रति सम्मान से अंतरात्मा की संविधान प्रदत्त स्वतंत्रता स्वतः समाप्त नहीं हो जाती।
राज्य राष्ट्रीय प्रतीकों के संबंध में नियम निर्धारित कर सकता है, लेकिन ऐसा विनियमन मौलिक अधिकारों और संवैधानिक सीमाओं के संगत होना चाहिए।
सुप्रीम कोर्ट ने अभी तक इस संवैधानिक चुनौती पर अंतिम निर्णय नहीं लिया है।
केंद्र सरकार का जवाब मांगा गया है।
2026 के संशोधन और संबंधित सरकारी दिशा-निर्देशों की वैधता और दायरा अभी विचाराधीन (sub judice) हैं।
महत्वपूर्ण प्रावधान: अनुच्छेद 14, 19, 21 और 25; राष्ट्रीय सम्मान अपमान निवारण अधिनियम, 1971 (जैसा कि 2026 में संशोधित हुआ)।
