Supreme Court: Insurer’s Office Does Not Confer Territorial Jurisdiction on MACT

Why in News?

On 16 September 2026, the Supreme Court held that the presence of an insurance company’s office at a particular place does not by itself confer territorial jurisdiction on the Motor Accidents Claims Tribunal (MACT) to entertain a compensation claim under Section 166(2) of the Motor Vehicles Act, 1988.

Key Legal Issue:

The Court examined whether a claimant can approach a MACT merely because the insurer carries on business within that Tribunal’s territorial jurisdiction.

Supreme Court’s Ruling:

  • Section 166(2), Motor Vehicles Act, 1988 permits a claimant to file a compensation claim before a Tribunal having jurisdiction over:

    • the place where the accident occurred;

    • the place where the claimant resides or carries on business; or

    • the place where the defendant resides or carries on business.

  • The expression “carries on business”, in the context of the claimant under Section 166(2), cannot be extended to the insurer merely because it has an office at that place.

  • An insurer’s business office alone does not create territorial jurisdiction for the MACT.

  • The Court rejected the argument that the beneficial nature of the Motor Vehicles Act permits jurisdiction to be assumed merely for the convenience of the claimant.

Important Procedural Point:

The Supreme Court clarified that:

  • Impleadment of an insurer as a defendant is optional in a motor accident claim petition.

  • However, once the insurer is impleaded as a respondent, it is entitled to raise all legally available grounds of defence, including an objection to territorial jurisdiction.

Facts of the Case:

  • The claimant filed a compensation petition before MACT, Chennai.

  • The insurer objected to territorial jurisdiction, arguing that no part of the cause of action arose in Chennai.

  • The accident had occurred outside Chennai and the claimant’s address also did not establish Chennai jurisdiction.

  • The MACT initially rejected the insurer’s objection because the insurer had a business office in Chennai.

  • The Madras High Court, exercising jurisdiction under Article 227 of the Constitution, held that MACT Chennai lacked territorial jurisdiction.

  • The Supreme Court dismissed the claimant’s appeal and upheld the High Court’s view.

Legal Principle:

Mere existence of an insurer’s office within the territorial jurisdiction of a MACT does not confer jurisdiction under Section 166(2) of the Motor Vehicles Act, 1988.

Mains Point:

Motor Vehicles Act, 1988: Important Notes

Introduction:

The Motor Vehicles Act, 1988 is the principal legislation governing motor vehicles in India. It regulates driving licences, registration of vehicles, permits, road safety, third-party insurance, accident compensation and offences relating to motor vehicles.

It replaced the Motor Vehicles Act, 1939 and came into force on 1 July 1989.

1. Driving Licence:

The Act makes a valid driving licence mandatory for driving a motor vehicle in a public place.

  • Section 3: No person can drive a motor vehicle in a public place without an effective driving licence.

  • Section 4: Prescribes the age limits for driving different categories of motor vehicles.

  • Section 5: Places responsibility on the owner/person in charge not to allow an unauthorised or underage person to drive.

  • Section 9: Deals with the grant of driving licences.

  • Sections 19–20: Provide for disqualification by the licensing authority and the Court.

2. Registration of Motor Vehicles:

A motor vehicle must be registered before it can be used in a public place.

  • Section 39: Makes registration compulsory.

  • The registration certificate establishes the legal identity of the vehicle and its registered owner.

  • Section 52: Regulates alteration of motor vehicles.

  • Section 56: Deals with the certificate of fitness of transport vehicles.

3. Permits:

Transport vehicles generally require a permit for their use in accordance with the Act.

  • Section 66: Provides for the necessity of permits.

  • Different types of permits include stage carriage, contract carriage, goods carriage and special permits.

  • Permit conditions regulate the manner and area in which transport vehicles may operate.

4. Road Safety:

The Act contains several provisions aimed at preventing road accidents and protecting road users.

Important areas include:

  • Speed restrictions

  • Safety of drivers and pillion riders

  • Use of protective headgear

  • Duties of drivers involved in accidents

  • Electronic monitoring and enforcement of road safety

Section 134 is particularly important because it prescribes the duties of a driver in cases involving an accident and injury to a person.

5. Third-Party Insurance:

The Act makes third-party motor vehicle insurance compulsory.

  • Section 146: Prohibits the use of a motor vehicle in a public place without the required third-party insurance.

  • Section 147: Specifies the requirements of insurance policies and the extent of liability.

  • Section 150: Deals with the insurer’s duty to satisfy certain judgments and awards against insured persons.

6. Accident Compensation:

The Act provides a statutory mechanism for obtaining compensation for victims of motor accidents.

Important provisions include:

  • Section 161: Compensation relating to hit-and-run motor accidents.

  • Section 164: Provides for compensation in specified cases on a no-fault basis.

  • Section 166: Provides for filing an application for compensation before the Motor Accident Claims Tribunal (MACT).

  • Section 168: Deals with the award of the Claims Tribunal.

  • Section 169: Prescribes the procedure and powers of the Claims Tribunal.

  • Section 173: Provides for an appeal against the award of the Claims Tribunal.

7. Motor Accident Claims Tribunal:

The MACT is established to provide a specialised mechanism for adjudicating claims arising from motor vehicle accidents.

The Tribunal can determine:

  • Liability for the accident

  • Amount of compensation

  • Persons entitled to compensation

  • Apportionment of liability, where applicable

8. Important Motor Vehicle Offences:

The Act penalises various violations relating to driving and use of motor vehicles.

Major offences include:

  • Driving without a valid licence

  • Allowing an unauthorised person to drive

  • Excessive-speed driving

  • Dangerous driving

  • Drunken or drugged driving

  • Driving an uninsured vehicle

  • Using a vehicle without registration

  • Using a vehicle without the required permit

Section 185: Driving by a person under the influence of alcohol or drugs

9. Juvenile Offences:

Section 199A contains special provisions relating to offences committed by juveniles.

It also imposes consequences on the guardian/owner in specified circumstances where a juvenile commits an offence involving a motor vehicle.

10. Powers of Authorities:

The Act gives enforcement authorities powers to ensure compliance with its provisions.

  • Section 206: Power to impound certain documents.

  • Section 207: Power to detain vehicles being used in specified violations, including use without registration or permit.

मोटर वाहन अधिनियम, 1988: महत्वपूर्ण कानूनी नोट्स

परिचय:

मोटर वाहन अधिनियम, 1988 भारत में मोटर वाहनों से संबंधित कानून को विनियमित करने वाला प्रमुख अधिनियम है। यह ड्राइविंग लाइसेंस, वाहन पंजीकरण, परमिट, सड़क सुरक्षा, तृतीय-पक्ष बीमा, दुर्घटना मुआवजा तथा मोटर वाहन संबंधी अपराधों को नियंत्रित करता है।

इसने Motor Vehicles Act, 1939 का स्थान लिया और 1 जुलाई 1989 से लागू हुआ।

1. ड्राइविंग लाइसेंस:

अधिनियम के अनुसार सार्वजनिक स्थान पर मोटर वाहन चलाने के लिए वैध ड्राइविंग लाइसेंस आवश्यक है।

  • धारा 3: वैध ड्राइविंग लाइसेंस के बिना मोटर वाहन चलाना निषिद्ध है।

  • धारा 4: मोटर वाहन चलाने के लिए आयु सीमा निर्धारित करती है।

  • धारा 5: वाहन के मालिक/प्रभारी को ऐसे व्यक्ति को वाहन चलाने की अनुमति देने से रोकती है, जो वैध रूप से वाहन चलाने के लिए अधिकृत नहीं है।

  • धारा 9: ड्राइविंग लाइसेंस प्रदान करने से संबंधित है।

  • धारा 19–20: लाइसेंस के निरर्हण (Disqualification) से संबंधित हैं।

2. मोटर वाहनों का पंजीकरण:

सार्वजनिक स्थान पर मोटर वाहन चलाने से पहले उसका पंजीकरण आवश्यक है।

  • धारा 39: वाहन के पंजीकरण को अनिवार्य बनाती है।

  • धारा 52: मोटर वाहन में परिवर्तन से संबंधित है।

  • धारा 56: परिवहन वाहनों के फिटनेस प्रमाण-पत्र से संबंधित है।

3. परमिट:

परिवहन वाहनों के संचालन के लिए सामान्यतः परमिट आवश्यक होता है।

  • धारा 66: परमिट की आवश्यकता से संबंधित है।

  • अधिनियम में Stage Carriage, Contract Carriage, Goods Carriage आदि के लिए विभिन्न प्रकार के परमिट का प्रावधान है।

  • परमिट वाहन के उपयोग, क्षेत्र तथा संचालन की शर्तों को नियंत्रित करता है।

4. सड़क सुरक्षा:

अधिनियम का एक महत्वपूर्ण उद्देश्य सड़क दुर्घटनाओं को रोकना और सड़क उपयोगकर्ताओं की सुरक्षा सुनिश्चित करना है।

इसमें मुख्य रूप से—

  • वाहन की गति पर नियंत्रण,

  • चालक एवं पिलियन राइडर की सुरक्षा,

  • सुरक्षात्मक हेलमेट का प्रयोग,

  • दुर्घटना की स्थिति में चालक के कर्तव्य तथा

  • सड़क सुरक्षा के लिए इलेक्ट्रॉनिक निगरानी

से संबंधित प्रावधान हैं।

धारा 134: दुर्घटना में व्यक्ति के घायल होने की स्थिति में चालक के कर्तव्यों से संबंधित महत्वपूर्ण प्रावधान है।

5. तृतीय-पक्ष बीमा:

अधिनियम के अंतर्गत Third-Party Insurance अनिवार्य है।

  • धारा 146: सार्वजनिक स्थान पर बीमा के बिना मोटर वाहन के उपयोग पर रोक लगाती है।

  • धारा 147: बीमा पॉलिसी की आवश्यकताओं तथा बीमाकर्ता की देयता से संबंधित है।

  • धारा 150: कुछ परिस्थितियों में बीमाकर्ता द्वारा न्यायालय/दावाधिकरण के निर्णय या अधिनिर्णय की राशि का भुगतान करने के दायित्व से संबंधित है।

6. दुर्घटना मुआवजा:

अधिनियम मोटर दुर्घटना पीड़ितों को मुआवजा प्राप्त करने के लिए वैधानिक व्यवस्था प्रदान करता है।

  • धारा 161: Hit-and-Run मोटर दुर्घटनाओं में मुआवजे से संबंधित है।

  • धारा 164: कुछ मामलों में No-Fault Liability के आधार पर मुआवजे का प्रावधान करती है।

  • धारा 166: मुआवजे के लिए आवेदन से संबंधित है।

  • धारा 168: Claims Tribunal द्वारा अधिनिर्णय (Award) से संबंधित है।

  • धारा 169: Claims Tribunal की प्रक्रिया और शक्तियों से संबंधित है।

  • धारा 173: Claims Tribunal के अधिनिर्णय के विरुद्ध अपील का प्रावधान करती है।

7. Motor Accident Claims Tribunal (MACT):

MACT मोटर दुर्घटनाओं से उत्पन्न मुआवजे के दावों के निपटारे के लिए स्थापित विशेष अधिकरण है।

यह मुख्य रूप से निर्धारित करता है—

  • दुर्घटना के लिए दायित्व,

  • पीड़ित को देय मुआवजे की राशि,

  • मुआवजा प्राप्त करने के हकदार व्यक्ति, तथा

  • जहाँ आवश्यक हो, संबंधित पक्षों के बीच दायित्व का विभाजन

8. प्रमुख मोटर वाहन अपराध:

अधिनियम विभिन्न प्रकार के मोटर वाहन अपराधों के लिए दंड का प्रावधान करता है।

प्रमुख अपराधों में शामिल हैं—

  • बिना वैध लाइसेंस वाहन चलाना,

  • अनधिकृत व्यक्ति को वाहन चलाने देना,

  • अत्यधिक गति से वाहन चलाना,

  • खतरनाक ढंग से वाहन चलाना,

  • शराब या मादक पदार्थ के प्रभाव में वाहन चलाना,

  • बिना बीमा वाहन चलाना,

  • बिना पंजीकरण वाहन का उपयोग करना,

  • बिना आवश्यक परमिट वाहन का उपयोग करना।

धारा 184: खतरनाक ढंग से वाहन चलाना
धारा 185: शराब/मादक पदार्थ के प्रभाव में वाहन चलाना
धारा 192: बिना पंजीकरण वाहन का उपयोग
धारा 192A: बिना परमिट वाहन का उपयोग
धारा 196: बिना बीमा वाहन चलाना

9. किशोर द्वारा किए गए अपराध:

धारा 199A किशोर द्वारा किए गए मोटर वाहन अपराधों के संबंध में विशेष प्रावधान करती है।

निर्धारित परिस्थितियों में अभिभावक/वाहन मालिक पर भी दायित्व लगाया जा सकता है।

10. अधिकारियों की शक्तियाँ:

अधिनियम प्रवर्तन अधिकारियों को कानून के अनुपालन को सुनिश्चित करने के लिए विभिन्न शक्तियाँ प्रदान करता है।

धारा 206: कुछ परिस्थितियों में दस्तावेजों को जब्त करने की शक्ति।

धारा 207: बिना पंजीकरण या बिना परमिट आदि के उपयोग किए जा रहे वाहनों को अभिरक्षा में लेने/निरुद्ध करने की शक्ति।

Supreme Court: MACT की क्षेत्रीय अधिकारिता और Insurer का कार्यालय

Why in News?

16 सितंबर 2026 को Supreme Court ने स्पष्ट किया कि केवल किसी स्थान पर बीमा कंपनी (Insurer) का कार्यालय होना, उस स्थान के Motor Accident Claims Tribunal (MACT) को क्षेत्रीय अधिकारिता (Territorial Jurisdiction) प्रदान नहीं करता।

मामला Motor Vehicles Act, 1988 की धारा 166(2) की व्याख्या से संबंधित था।

मुख्य कानूनी प्रश्न:

क्या केवल इस आधार पर MACT को क्षेत्रीय अधिकारिता प्राप्त हो सकती है कि बीमा कंपनी उस क्षेत्र में व्यवसाय करती है या उसका कार्यालय वहाँ स्थित है?

Supreme Court का निर्णय:

धारा 166(2) के अंतर्गत मुआवजे का दावा उस Claims Tribunal के समक्ष किया जा सकता है, जिसकी अधिकारिता में—

  • दुर्घटना का स्थान आता हो;

  • दावाकर्ता निवास करता हो या व्यवसाय करता हो; या

  • प्रतिवादी निवास करता हो या व्यवसाय करता हो

न्यायालय ने स्पष्ट किया कि “carries on business” अभिव्यक्ति को केवल इस आधार पर बीमाकर्ता पर लागू नहीं किया जा सकता कि उसका किसी स्थान पर कार्यालय है।

अर्थात्—

केवल Insurer का कार्यालय किसी स्थान पर होना, MACT को स्वतः territorial jurisdiction प्रदान नहीं करता।

Insurer को Defendant बनाने का प्रभाव:

Supreme Court ने यह भी स्पष्ट किया कि—

  • Motor accident claim petition में Insurer का impleadment अनिवार्य नहीं है

  • लेकिन यदि Insurer को respondent के रूप में implead किया जाता है, तो वह कानून द्वारा उपलब्ध सभी वैध बचाव उठा सकता है।

  • इसमें territorial jurisdiction पर आपत्ति भी शामिल है।

मामले के तथ्य:

दावाकर्ता ने MACT, Chennai के समक्ष मुआवजे का दावा प्रस्तुत किया।

बीमा कंपनी ने Chennai MACT की territorial jurisdiction पर आपत्ति की, क्योंकि—

  • दुर्घटना Chennai में नहीं हुई थी;

  • दावाकर्ता का निवास भी Chennai की jurisdiction स्थापित नहीं करता था;

  • केवल Insurer का Chennai में business office होना पर्याप्त आधार नहीं था।

MACT ने प्रारंभ में Insurer की आपत्ति स्वीकार नहीं की।

इसके बाद Madras High Court ने Article 227, Constitution of India के अंतर्गत हस्तक्षेप करते हुए माना कि MACT, Chennai के पास territorial jurisdiction नहीं थी।
