Why in News?  The Supreme Court of India strongly criticized a judge of the Allahabad High Court, Justice Prashant Kumar, for allowing a criminal case to proceed in a matter that was purely a civil dispute.

The Case:
A person filed a criminal complaint against a buyer who had not paid the full amount in a sale transaction. Instead of directing the person to file a civil suit for recovery, Justice Kumar allowed criminal proceedings under the charge of criminal breach of trust.

Why the Supreme Court is Upset?

• The Supreme Court said this was a misuse of the criminal justice system.
• It said that such disputes are meant to be resolved through civil law, not criminal charges.
• The court was shocked that the High Court judge thought criminal action would be a quicker way to recover the unpaid money.
• The Bench (Justices J.B. Pardiwala and R. Mahadevan) called this thinking completely wrong and said it makes a mockery of justice.

• The judge “cut a sorry figure for himself” — meaning he acted in a way that embarrassed his position.
• The court questioned whether such orders are passed due to lack of legal knowledge or other questionable reasons.

• The offence of criminal breach of trust requires a person to entrust something (like money or property) to another, who then misuses it.
• In a normal sale, there is no entrustment, so criminal breach of trust does not apply.

Essential Elements of Criminal Breach of Trust:

1. Entrustment of Property – Property must be entrusted to the accused by the victim or their representative.
2. Dishonest Misappropriation or Conversion – The property must be dishonestly used for personal gain or for someone else.
3. Violation of Trust – Misuse must breach a fiduciary or legal obligation.

मामला क्या था?

एक व्यक्ति ने एक खरीदार के खिलाफ आपराधिक शिकायत दर्ज करवाई, क्योंकि उसने बिक्री लेन-देन में पूरा भुगतान नहीं किया था। न्यायाधीश ने शिकायतकर्ता को दीवानी मुकदमा दायर करने की सलाह देने के बजाय, आपराधिक विश्वासघात (Criminal Breach of Trust) के तहत आपराधिक कार्यवाही की अनुमति दे दी।

सुप्रीम कोर्ट क्यों नाराज़ है?

• सुप्रीम कोर्ट ने इसे आपराधिक न्याय प्रणाली का दुरुपयोग बताया।
• ऐसे विवादों का समाधान दीवानी कानून के तहत किया जाना चाहिए, न कि आपराधिक मामलों के जरिए।
• कोर्ट इस बात से स्तब्ध था कि हाईकोर्ट के न्यायाधीश ने जल्दी पैसा वसूलने के लिए आपराधिक मामला दर्ज करना बेहतर तरीका बताया।
• पीठ (न्यायमूर्ति जे.बी. पारडीवाला और आर. महादेवन) ने कहा कि यह सोच पूरी तरह से गलत है और इससे न्याय की प्रणाली का मज़ाक बनता है।

सुप्रीम कोर्ट की कड़ी टिप्पणी:

• अदालत ने कहा कि न्यायाधीश ने “खुद को शर्मनाक स्थिति में ला खड़ा किया” (cut a sorry figure for himself)।
• कोर्ट ने सवाल उठाया कि क्या ऐसे आदेश कानूनी अज्ञानता या बाहरी दबाव के कारण दिए जा रहे हैं।
• अदालत ने इसे अक्षम्य (unpardonable) और न्यायिक कदाचार करार दिया।

आपराधिक न्यासभंग (Criminal Breach of Trust) :

परिभाषा (धारा 405, भारतीय दंड संहिता):
जब कोई व्यक्ति जिसे किसी संपत्ति या उस पर अधिकार सौंपा गया हो, उस संपत्ति का बेईमानी से दुरुपयोग करता है या उसे अपने उपयोग में लाता है, या किसी कानूनी निर्देश या अनुबंध का उल्लंघन करता है, तो वह आपराधिक न्यासभंग (Criminal Breach of Trust) का अपराध करता है।

महत्वपूर्ण शब्द – “सौंपना” (Entrustment):
इस अपराध में “संपत्ति सौंपने” का अत्यंत महत्व है, क्योंकि इससे स्पष्ट होता है कि आरोपी के पास संपत्ति विश्वासपूर्वक दी गई थी। यह विश्वास का उल्लंघन इस अपराध को साधारण चोरी या गबन से अलग करता है।

आपराधिक न्यासभंग के आवश्यक तत्व:

1. संपत्ति का सौंपा जाना – संपत्ति पीड़ित या उसके प्रतिनिधि द्वारा आरोपी को सौंपी गई होनी चाहिए।
2. बेईमानी से दुरुपयोग या रूपांतरण – संपत्ति का उपयोग स्वार्थ या किसी और के हित में बेईमानी से किया गया हो।
3. विश्वास का उल्लंघन – यह कार्य कानूनी या संविदात्मक जिम्मेदारी के उल्लंघन के रूप में होना चाहिए।
