Why in News?

The Arvind Malhotra v. High Court of Himachal Pradesh controversy has renewed debate over transparency, accountability, merit and confidentiality in India’s judicial appointments system. It also highlights the contrast between India’s Collegium System and the more open judicial appointment mechanism of South Africa.

Arvind Malhotra Case:

  • Arvind Malhotra, a senior judicial officer in Himachal Pradesh, challenged the elevation of junior judicial officers while his candidature was not considered.

  • The controversy raises concerns regarding seniority, merit, transparency and reasons for selection/non-selection.

  • The Supreme Court earlier held that reconsideration of elevation must be undertaken by the High Court Collegium collectively, rather than by the Chief Justice individually.

  • In 2026, the Supreme Court declined to directly interfere with the Collegium’s selection decision, highlighting the limited scope of judicial intervention.

Constitutional Framework:

  • Article 124: Appointment of Supreme Court judges.

  • Article 217: Appointment of High Court judges.

  • Three Judges Cases: Led to the evolution of the present Collegium System.

  • High Court Collegium: Chief Justice + two senior-most judges.

  • Supreme Court Collegium: CJI + four senior-most judges.

  • The process also involves government inputs, background verification and the Memorandum of Procedure (MoP).

Why Confidentiality is Important?

  • Protects judicial independence.

  • Enables frank assessment of a candidate’s merit and integrity.

  • Prevents political and external pressure.

  • Protects sensitive information relating to candidates.

Problems with Excessive Secrecy:

  • Reasons for selection or non-selection may remain unclear.

  • Creates questions regarding seniority versus merit.

  • Limits institutional accountability.

  • May create perceptions of arbitrariness or favouritism.

  • Can weaken public confidence in the judiciary.

South African Model:

The Judicial Service Commission (JSC) follows a relatively more transparent approach.

  • Includes judges, lawyers, academics and political representatives.

  • Candidates undergo public interviews.

  • Proceedings are subject to public scrutiny.

  • Candidates’ qualifications, conduct and independence are examined.

  • Greater emphasis is placed on transparency and accountability.

India vs South Africa:

India: Confidential deliberation → greater emphasis on judicial independence

South Africa: Public scrutiny → greater emphasis on transparency and accountability

Way Forward:

  • Establish clear and objective criteria for judicial appointments.

  • Provide adequate reasons for selection/non-selection, while protecting sensitive information.

  • Make the institutional framework transparent without compromising confidentiality.

  • Ensure effective collective consultation within the Collegium.

  • Strengthen judicial accountability and complaint mechanisms.

  • Maintain a balance between independence, merit, transparency and accountability.

Constitutional Balance:

Judicial Independence + Merit + Transparency + Accountability

The objective should be structured transparency with necessary confidentiality, rather than either complete secrecy or complete public disclosure.
