Why in News?

Supreme Court Justice Ujjal Bhuyan highlighted that Article 124(3) allows a “distinguished jurist” to become a Supreme Court judge, but this provision has never been used in over 76 years.

Constitutional Provision:

Article 124(3) provides three routes to become a Supreme Court judge:

  • High Court Judge: At least 5 years of judicial service.

  • Advocate: At least 10 years of practice in a High Court.

  • Distinguished Jurist: A person considered a “distinguished jurist” by the President.

Key point: The Constitution does not define “distinguished jurist” or prescribe minimum experience for this category.

Why was this Provision Included?

The Constituent Assembly intended to:

  • Widen the pool of candidates for SC appointments.

  • Bring legal scholars and academics into the judiciary.

  • Promote professional diversity in the Supreme Court.

  • Recognise that exceptional legal expertise is not limited to judges and practising advocates.

H.V. Kamath: Favoured a “wider field of choice” for SC appointments.

The Assembly discussed Felix Frankfurter, a Harvard Law professor for about 25 years, who was appointed to the U.S. Supreme Court in 1939.

His appointment demonstrated that deep legal scholarship can also contribute to constitutional adjudication.

Why Has the Provision Remained Unused?

Collegium-driven appointments:

  • Although Article 124 mentions the President, the actual appointment process involves the Supreme Court Collegium.

  • A distinguished jurist would therefore need to emerge through this recommendation process.

Lack of clear criteria:

  • No constitutional definition of “distinguished jurist”.

  • No objective eligibility or selection standards.

Courtroom experience concern:

  • Academics may have limited experience with court procedure, litigation and practical application of law.

Professional separation:

  • Full-time law teachers generally cannot simultaneously practise as advocates under Bar Council rules, widening the gap between “law in books” and “law in action.”

Important Historical Development:

  • 1949: “Distinguished jurist” included as a qualification for Supreme Court judges.

  • 1976: 42nd Constitutional Amendment temporarily introduced the same category for High Court judges under Article 217.

  • 1978: 44th Constitutional Amendment removed it from High Court qualifications.

  • Today: It remains constitutionally available for Supreme Court appointments under Article 124(3).
